Watch this space. My client, @theHFDF, filed a petition for certiorari in the SCOTUS in its challenge to the Los Angeles Unified School District's mandate for employees to be vaccinated against COVID. The Court ordered LAUSD to respond to the petition and HFDF filed a reply. The petition and briefs have been distributed for conference on May 14, 2026, so a decision on whether the Court has granted the petition should come out on Monday, May 18. The Holy Grail of COVID litigation was to abrogate, or at least limit, the Court's 1905 decision in Jacobson v. Massachusetts. During the course of the pandemic, courts across the country genuflected before Jacobson, almost as if it granted the States a license to impose whatever restraint on liberty they wanted in the name of public health. But Jacobson long pre-dated the Court's opinions on bodily autonomy and the right to refuse unwanted medical treatment. Granting cert in this case would give the Court an opportunity to reconsider Jacobson or at least clarify its scope. It would also, as HFDF pointed out in its reply brief, give the Court an opportunity to explain that Dobbs was not the death-knell for the right to bodily autonomy. cc: @DavidLat @SCOTUSblog

Trump should take this opportunity to announce that, in honor of the deceased pilots of Air Canada Flight 8646, he has directed his administration to explore privatizing our nation's air traffic control system, as did Canada in 1996. Because it would be supported by user fees instead of taxpayer dollars, privatization would free our nation's air traffic control system from the vagaries of Congressional funding and bureaucratic red tape.

I don't know if the rest of the world is aware that in France during Covid, people had to write down or print an authorization that allowed them to go out, no further than one kilometer and no longer than one hour, an authorization that was granted to them by... themselves. You read that right: prople signed themselves the papers allowing them to go out. It was a dream come true of the communist dictatorship I spent decades exposing: transforming people into their own police, their own surveillance. You would think people would rebel against such absurdity. But you would be wrong - the media, intellectual elite, and political class unanimously approved these measures and immediately portrayed anyone daring to express any doubt as a far right supporter intent on killing others. It was the death of critical mind. And if it was not unanimous in the population, censorship made sure that this never became visible. Side note: the only political force that greatly benefited from this feat was of course the extreme right. Never forget 😡
