SCOTUS just validated what many have been saying for generations: the Indian Child Welfare Act is the gold standard of child welfare policy. This decision upholds the constitutionality of this law, respects Tribal sovereignty, and protects the best interests of Indian children.
Indian Country is breathing a big sigh of relief this morning. The widely held expectation was that ICWA would fall or be diminished in some way. Experts and advocates are calling this a win for tribal nations and their sovereignty.
Today the #SCOTUS upheld the Indian Child Welfare Act in an opinion authored by Justice Barrett. Much of the fight has been left for another day--in that #SCOTUS declined to reach some of the thorniest issues. But ICWA survives. So much to learn here. supremecourt.gov/opinions/22…
