It’s worth noting that in Sorsby’s lawsuit against the NCAA, Jeff Kessler’s whole argument was based on the NCAA’s assertion that its primary mission is to protect and benefit college athletes, which Kessler said it failed to do by not considering Sorsby’s addiction and mental health. The Big 12 has never made such as assertion, and its Mission Statement is vastly different than the NCAA’s.
Under Texas law, courts defer to the internal affairs and rules of private associations and will not substitute the court’s judgment for the association's decision (such as membership revocation, rule-making, or expulsion) unless the association failed to follow its own bylaws or acted in bad faith. So how does Texas Tech get around that? ⬇️

One reason I am not convinced the Big 12 does anything to Tech: it’s going to need Tech badly to elevate the league as it goes to take its TV deal to the open market. Tech is the only Big 12 team bringing in talent at that top level.

I can’t help but wonder whether the people advising Brenden Sorsby were really concerned about his mental health and well-being. Can you imagine being in a recovery program when almost every other post on “X” mentions you as the main villain in a story that has outraged virtually everyone in college sports? That would put a strain on anybody - even if they weren’t in a recovery program. The fact that Texas Tech hasn’t already unplugged Sorsby from this nightmare speaks volumes about whether they really give a rat’s ass about this young man’s mental health or what’s best for his future. Actions speak louder than words.
This is really well said. Sorsby shouldn’t play but it’s not as simple as “you’re off the team” if the coaches truly care about him and his well being. Happy compromise, he stays on the team. He gets the help, the scholarship, the money, practice. He just doesn’t play.

Eh ... theyd probably just make Tech ineligible for the CCG. That keeps a big12 team in the CFP and could give them 2 if Tech gets an at large bid.
Now the Big 12 is discussing on using an option in their bylaws that prevents Texas Tech from being the conferences representative in the CFP. This is from the ESPN article about the Big 12 AD meeting yesterday.

Texas Tech should support the young man. Texas Tech should not play the young man. Texas Tech has the ability to do both. Anything beyond that is an excuse not to do the right thing.

That could deter some potential punitive action but not nearly all of it. For instance, a court can't compel individual teams to play Tech, for instance. A court cant compel the committee to include Tech in the CFP discussion or the CFP itself.
