🇩🇪⚖️"Germany’s draft law implementing the revised EU Product Liability Directive received mixed reactions from experts in the German Bundestag’s Committee on Legal Affairs and Consumer Protection hearing”, comments Dr Herbert Woopen for EJF. The draft reform proposes i.a.: ▫️product liability rules expansion to software and artificial intelligence systems, ▫️introduction of liability for certain actors in the supply chain where manufacturers are based outside the EU, ▫️damage claims facilitation. During the hearing, Julian Kulaga - German Chamber of Industry and Commerce (DIHK) supported introduction of a fully-fledged “in camera procedure”into German civil procedure law 📄🔒. The proposal would ensure that only the court receives full access to confidential evidence, while parties and their representatives would receive only the court’s assessment, without disclosure of trade secrets or other confidential business information 🛡️. The Financial Times recently covered rising US business concerns around the revised EU Product Liability Directive (PLD), including claims that the new framework could shift the burden of proof onto defendants in complex cases. Important analysis by @ECIPE shows the substantial economic burden imposed by the revised Product Liability Directive (PLD). As implementation progresses unevenly across the Member States, the cumulative impact on EU manufacturers of the reversal of the burden of proof in PLD, combined with unregulated TPLF and increasing US-style mass litigation, has long been flagged as a major concern by European industries in all sectors. With this report, ECIPE provides alarming data and evidence to back-up industry's concerns - concerns that can no longer be ignored.
