Just as a reminder -- the IRS generally has 3 years to audit from the date filed. So, for those 2023 UTP accruals -- assuming return filed on Oct 15th (extension); the UTP essentially goes away on Oct 15th 2027 (or March 15th if filed on time).

What would Cash Flow from Operations look like if there was no 280E on a cumulative basis (2019 - 2025). This is a rough estimate. UTP used in the calculation excludes interest/ penalties and non 280E items. You don't want us to have situation where you have these cash rooms, where you have hundreds of thousands of dollars of cash sitting in a location. As a reminder, in a letter to @USTreasury and @revenue_irs Oct 2024 the @AICPA (American Institute of Certified Public Accountants) requested guidance for "Cannabis Businesses Transitioning Away From Application of Section 280E". The request included (but not limited to), 2 key recommendations: I. Retroactive Treatment for Expenses Previously Subject to Section 280E. >Recent IRS guidance indicates 280E elimination retroactive to Jan 1 2026 ✔️ HOWEVER, the administrator encourages @SecScottBessent to provide relief "for taxable years in which a state licensee operated under a state medical marijuana license" (TBD 🤞). II. Uniform Tax Treatment Among Cannabis Businesses >The AICPA recommends that Treasury and the IRS issue guidance ensuring that upon the rescheduling of marijuana as a Schedule III controlled substance, section 280E apply EQUALLY to ALL cannabis businesses legally operating within their respective states, REGARDLESSS of whether they sell MEDICAL marijuana or RECREATIONAL marijuana.
