So: a further utterly NONSENSICAL aspect of the ruling against Everton by the independent commission is that they openly admit to relying heavily on evidence from David Baldwin to establish the link between £19.5m overspend and the 4 points extra Everton gained ahead of Burnley. 1. David Baldwin, and by the IC's OWN ADMISSION, had spent 6 years being associated with Burnley. 2. His testimony was treated as that of an 'expert' despite him admitting he was using his "lived experience". Seriously? 3. The gist of Baldwin's argument was that Everton's £19.5m overspend - which was cumulative over 3 years - could you be used entirely to support the extra 4 points Everton gained over and above Burnley in the one season, 21/22. This was without him using any mathematical, statistical or probabilistic modelling - just 'lived experience' 4. Remember, we already established that the IC thinks a PSR breach can occur at anytime, 365 days a year, during a 3 year cycle - and not at the point they are actually tested. This is 'dangerous & unworkable' as Everton put it in their statement & also highly likely why they were so angry. There is no way the rules were drafted to intend this. It also means if you were already in breach of PSR but sold hotels or your women's team to cure it, you are still in breach. Clearly a nonsense, because in several instances these "cures" have been allowed - *as long as it was done by the financial year end, when PSR was being tested*. This is a key pillar of Everton's defence - Burnley were relegated before Everton's year-end and so a PSR breach had not yet occured. 5. Baldwin's testimony is used to rebuff that; he infers that sporting advantage was gained already at the start of the season because Everton did not reduce their squad/sell players/adjust their PSR position. Not true. Everton submitted an initial PSR position showing compliance - they did not set out to breach.

PUNISHMENT: £10m fine —— Everton meanwhile, slightly breach PSR, overspending by £19.5m over the allowable £105m limit in one period, largely linked to stadium investment & COVID impacts. PUNISHMENT: 10 point deduction followed by a another 2 point deduction both which directly affected their league position and prize money whilst risking being relegated from the Premier League.. AND now have to pay Burnley £40m for alleged lost earnings due to Everton’s “unfair advantage!?” —— One club hid tens of millions in shady payments for years and got a slap on the wrist. The other got hammered with points lost, risked being relegated, costing millions in prize money for league placement and now have to pay compensation to clubs as well!? The disparity in severity, sporting impact and deterrence makes the rules look ridiculous and unfair. “Big” clubs get no consequences for their actions, while Everton are the league’s whipping boy suffering multiple existential hits. Why are Everton treated so differently to every other club in the league!?

Let’s trust that the Friedkins know what they’re doing. This Burnley case was there before they took over and they should’ve made plans for these fines. This won’t change how we spend in this transfer window. Worst case, just up the price of the donuts 🍩🤷‍♂️

Everton will appeal the decision, they have two weeks to log it. No timeframe when an appeal will be heard Burnley's legal team told the panel their "financial circumstances are so weak" if EFC are successful on appeal there's "a real risk Burnley would be unable to pay it back"
A reminder, Everton breached PSR by £19.5m but this doesn't state it wasn't on player trading. It was stadium build interest Money was moved from club operations to the build when the USM naming rights deal was pulled Everton worked with the PL & thought it could be added back

Feels like a dangerous road for football to go down. Everton have already been punished with a points deduction. The club's statement is right to question the precedent. If clubs can be retrospectively sued over league positions and hypothetical outcomes, where does it stop?
