I've shown it to several people, and everyone seems to have a different answer. Some recognize it from years ago, while others are completely stumped.

There is no reference in Law as to whether the hand is clenched into a fist. It’s purely down to whether the force is negligible or not. Now determining such a relatively subjective matter is difficult in low level incidents - whereas full on slaps or punches are easier
