Great to join a GMU Scalia Law panel this week to discuss Chevron v. Plaquemines Parish, including the key takeaways from Justice Thomas's majority opinion. As I explain, to remove a case to federal court under the Federal Officer Removal Statute, three elements must be met: — You must be acting under a federal officer — The suit must be for, or relate to, an act under color of federal law — You must be able to assert a colorable federal defense However, Plaquemines only really addressed the second element. So while these cases should all be removed to federal court, there will likely be more litigation moving forward to get there.

Here’s a thought, maybe the ESG embracing majors should pay for the transmission they claim to desperately need. It’s only “needed” to meet their Net Zero (Green New Scam) goals. As @rfelliott points out, oil is traded globally — blocking US exports would only raise prices and cause producers to cut production. More regulation = less production = less oil = higher prices.

“The PUC shall initiate action to reduce residential ratepayer transmission costs by July 31, 2026.” If implemented, this is a BIG win for Texas ratepayers that will not have to pay for the proposed massive high voltage power lines known as 765kv. Governor Abbott directed the PUC and ERCOT to protect Texans from footing the bill for data centers. His plan requires data centers to cover their own infrastructure costs, lowers transmission costs for residents, and safeguards Texas communities and natural resources.
