The dispute centered on whether refinery activities in the 1940s involved materials that met CERCLA’s definition of hazardous substances or fell within the petroleum exclusion and standard operational practices of the time, and whether the company disposed of hazardous substances and should share environmental response costs associated with the site. The Atlanta Hawks NBA franchise faced significant exposure after suspected financial misconduct by a senior finance executive, raising questions around internal control failures, the scope of potential losses, and insurance recovery. Engaged by outside counsel, J.S. Held’s forensic accounting and investigations experts conducted a comprehensive internal investigation—including data collection and records review, multi‑year transactional analysis, damages quantification, and witness interview support—to determine how the misconduct occurred and assess the financial impact. Our independent findings supported the organization’s fidelity insurance recovery efforts and assisted law enforcement and prosecutors by organizing and clarifying complex financial evidence. Less than six months after discovery, the matter resulted in a guilty plea, a federal prison sentence, and restitution exceeding $3.8M, alongside a full recovery under the organization’s insurance policy.
