DC U.S District Court Judge Royce Lamberth has granted Ørsted a stay of the Dec. 22 BOEM stop-work order allowing Revolution Wind to resume construction. He didn’t buy @TheJusticeDept national security arguments. Said new @DeptofWar assessment from Nov. 2025 was not acted upon until Dec. 22. He reviewed the national security information and said government position was “unjustified.”
@TheJusticeDept attorney was very unconvincing and didn’t make strong case before the judge. It’s hard to make a strong case when the premise is not a true national security concern but a political hack job. More in my recent op-ed from @_RCEnergy: realclearenergy.org/articles…
Lamberth said he was concerned by recent media statements from @DougBurgum criticizing offshore wind for a variety of reasons other than national security. Lamberth said, “the December 22 stop work order is arbitrary and capricious.”
Judge Lamberth said DOI and BOEM failed to provide reasoning to Revolution Wind. Revolution Wind had US experts with top secret clearances including retired vice admiral but information was never provided to them.
