In Minnesota, consumers who lose these cases have almost no protections for their bank accounts.
This means that their entire bank accounts could be frozen, sometimes before they even get notice. This could leave people without a penny for food or rent. (7/x)
This all results in a massive power imbalance in debt collection cases.
Because of that power imbalance, debt collectors win 82% of cases by default – typically when consumers can’t or don’t answer the lawsuit. (6/x)
There are also disparities in legal representation. Almost all debt collectors have attorneys. Almost no consumers do.
Plus, when consumers are sued, it costs them $285 in filing fees to respond. That's a huge barrier, especially for people being sued over debt. (5/x)
There are significant racial disparities in debt collection.
Black and Latino Minnesotans are sued at 2-3 times the rate of white Minnesotans, even when they have the same incomes.
This is a problem. It didn't happen by accident and it won't be solved by accident either. (4/x)
Consumer debt collection lawsuits—like for credit cards and medical debts—are more than half (51%) of all civil lawsuits in Minnesota.
A majority of our court’s business is now helping debt collectors and creditors collect money from Minnesotans. That's not right. (3/x)
