I really enjoyed working on this essay for the Harvard Law Review, entitled “The Supreme Court Under Threat: Early Lessons in Judicial Self-Protection.” (Link provided in the comment below.) In the essay, Neil Siegel and I discuss various tools of self-protection that the Supreme Court can and does use to protect itself from political threats, and we provide several case studies from the nineteenth century as illustrations. We are in the process of fleshing all of this out and expanding the history as part of a book that we’re writing together, tentatively entitled “Justices Under Fire: How the Supreme Protects Itself in Times of Political Threat.” @NeilScottSiegel

New (little) paper: Federal courts aren’t supposed to engage in “abstract review” of government policies, but something like it is happening in district courts anyway. If that’s a problem, maybe try one of these off-the-wall proposals to centralize abstract review. Link below.

Fred Schauer was my dad's favorite professor in law school. Fred really hated me reminding him of that 👨‍🏫❤️
I got an email today from an incoming LLM student at UCLAW, who wrote: "My father also completed his LL.M. at UCLA almost twenty years ago and has spoken very highly of you and your teaching over the years. His experience at UCLA, and his longstanding praise for your classes, has made the opportunity to study under you one of the aspects of the program I am most looking forward to." On the one hand, very gratifying. On the other hand, my main reaction has been "Gawd, I'm old."
