New (little) paper: Federal courts aren’t supposed to engage in “abstract review” of government policies, but something like it is happening in district courts anyway. If that’s a problem, maybe try one of these off-the-wall proposals to centralize abstract review. Link below.

My latest in the @YaleJREG blog, responding to @RichardMRe's @DividedArgument post on a "legal alignment" between "textualists" and "non-textualists.” Building off the work of @StephenESachs, I argue that no alignment exists because, while both camps may use similar procedures, they don't embrace the same "standard of rightness.” That is, “they[] still disagree about what makes an interpretive answer a legally correct one."
