I have been saying this for a long time. Please study the enforcement of, and the resistance to, the Fugitive Slave Act of 1850, because that's where we're headed.
Working on it!

I am excited to announce that @NotreDameLRev has just published my article, “Freedom Seekers: the Transgressive Constitutionalism of Fugitives from Slavery”
Prof. Zietlow (@ProfessorRZ) examines how fugitive slaves (“freedom seekers”) significantly impacted the Reconstruction Congress on issues such as interstate comity, federalism, citizenship rights, and fundamental human rights despite how history may overlook their contribution.

Until now, fugitives from slavery have largely been absent from the legal scholarship about the Reconstruction Era. This article (part of a larger project on what I call performative constitutionalism (using actions to make Const claims) seeks to remedy that oversight.
