In granting the Gov's motion to stay the CIT's order granting an injunction on 122 tariff collection (only for importer plaintiffs)... the Federal Circuit found that the Government "... had made a sufficient showing that it is likely to succeed on the merits," suggesting that the Federal Circuit may overturn the CIT's ruling that the 122s are illegal!

BREAKING: In the 122 tariff litigation, the Federal Circuit has GRANTED the government's motion to stay the CIT's judgment pending appeal!

A RETROACTIVE TARIFF? #CIT ruled @POTUS's 122 tariffs illegal b/c #Trump didn't cite a valid definition for a "balance-of-payments deficit" in Proclamation 11012... @SkaddenArps has speculated #Trump could issue a new proclamation w/ the correct definition and assert it has retroactive effect. IMO this unlikely as Courts have consistently said any grant of legislative authority, especially retroactive, must be explicitly granted. As @millerchevalier notes: "The Supreme Court has explained that statutes, rules, and regulations cannot be applied retroactively, unless clearly authorized by Congress"
