In regards to the Virginia crash that happened on May 29th which caused the FMCSA to sue the state of New York for allowing a driver who does not speak english to hold a CDL...this goes much deeper than that.
The driver, 48 year old Jing Sheng Dong is a naturalized US citizen. I am a naturalized US citizen, and I know that when you have your interview, not only do you need to have all documents in order, there are also tests you have to pass. One of them is a test on English Language Proficiency...which is an absolute joke.
For the reading test, you must read aloud ONE out of 3 sentences correctly from a tablet. Same for the writing test, only one of the 3 sentences must be written correctly. There is a waiver- if you are 50 years old or older during the interview and have been a permanent resident for 20 years, you don't have to take the English language test, OR if you are 55 years or older and have been a permanent resident for 15 years. The civics test, in this case, would be performed in the applicant's native language. But this doesn't apply to Mr. Dong who is currently 48 years old.
