My understanding is this is one of the provisions related to treaties now being "living documents." As new rights are gained by other Indigenous groups, they can potentially be added to already ratified treaties. Depending on what's at stake, the consequences could be dramatic.

The Certainty Provisions now, allow for future rights to be exercised as theyāre defined.
What does that mean?
Well, if the Cowichan decision stands, Aboriginal Title being a prior and superior right to the land over fee simple COULD be one example.
These are very serious and difficult conversations to have.
But at the end of the day, we need CERTAINTY with Treaty in order for them to withstand the test of time.
What the NDP has done here once again, is placed ideology over common sense, logic, and the public interest.
These treaties need to be stable and predictable 5, 10, 100 years down the road.
As of today, they are not.
