Breaking AI news - South Korea's AI Law (the Basic Act on the Development of Artificial Intelligence and the Establishment of a Foundation for Trustworthiness, or "AI Basic Act") just became fully enforceable, ahead of the EU AI Act.
South Korea becomes the first country with a comprehensive AI regulatory framework, prioritizing safety, trust, and innovation.
Key Aspects of the 2026 AI Basic Act:
1. Purpose & Scope:
The legislation aims to foster a safe and trustworthy AI ecosystem to support South Korea's goal of becoming a top-three global AI power, while balancing strict regulation with incentives for innovation for startups.
The Law requires developers and companies to take responsibility for AI-driven misinformation and harmful content.
2. High-Impact AI Regulation: AI systems in critical sectors such as nuclear power, transport, medical care, criminal investigation, and financial services are subject to strict transparency and safety requirements.
3. Deepfake/Generative AI Rules: Companies must provide prior notice when using AI in services and clearly label AI-generated content (including deepfakes) that is difficult to distinguish from reality.
4. Human Oversight: High-impact AI must incorporate human-in-the-loop or review capabilities.
5. Enforcement & Penalties: The Ministry of Science and ICT is empowered to investigate violations, with fines of up to 30 million won (approximately USD 20,400) for failing to meet obligations.
Transition Period: A grace period of at least one year is provided for companies to adjust to the new regulations before penalties are strictly enforced.
