My submission to the NSW Inquiry - Measures to prohibit slogans that incite hatred
I was technically late (I didn’t finish it until just before midnight), so I don’t know if they will accept it. As the upload functionality was closed, I had to email it, and I requested confirmation one way or the other, but there has been total silence.
Submissions closed on the 12th and today is 15/1 and about 1445 hours, the submission are still not available on the website! They make us work hard, but don’t respond in kind and with respect.

Recommendations
1. The Committee should extend the submission period and reconvene when key stakeholders have adequate opportunity to provide considered input.
2. Any inquiry into hateful speech should examine all forms of hatred equally, including Islamophobia, anti-Palestinian racism, homophobia, transphobia, and ableism.
3. The Committee should commission constitutional advice on whether proposed measures meet the Lange/McCloy test before making recommendations.
4. The UK, France and Germany should be treated as cautionary examples rather than best practices.
5. The Committee should examine the enforcement of existing laws before recommending new offences.
6. Any legislative response should be proportionate, necessary, and not designed to suppress legitimate political advocacy.
7. Decisions about permissible speech should not rest with police or other authorities without judicial oversight. The Bjelke-Petersen era demonstrates the consequences.
8. The inquiry should acknowledge the context that has prompted protests, including the ongoing conflict in Palestine and the findings of international courts.
9. The Committee should recommend the establishment and period of use of a centralised, verified national hate crime database as a precondition to any expansion of criminal offences.
