Experience of appearing before the Delhi High Court Vacation Bench today… The court commenced sharply at 10:30 a.m. and, as is often the case during vacations, the functioning was limited with only two Hon’ble Judges sitting on alternate days. Naturally, unless a matter reflects real urgency, getting it listed before the Vacation Bench is not easy. In the morning, I mentioned an education matter concerning a Class 12 student who had been unable to obtain his answer sheets through the online portal within permitted timelines…Considering the urgency involved, I requested that the matter be listed, and thankfully, the Hon’ble Court permitted the same for hearing on the very day. Even before the regular board started, there were nearly 25-30 mentionings before the Court seeking urgent listing, which included cases where urgent hearing was disallowed by the Joint Registrar. The day began with a Division Bench comprising Hon’ble Mr. Justice Saurabh Banerjee and Hon’ble Mr. Justice Amit Sharma hearing around 26 matters. Thereafter, proceedings continued before the Single Bench. Around 55 matters were already listed and, after urgent matters permitted during the day were added through the supplementary list, the cause list eventually reached around 67 matters. My matter was Item No. 61 and was finally taken up around 5:45 p.m. One thing that genuinely stood out throughout the day was the calm and composed manner in which Hon’ble Justice Saurabh Banerjee dealt with every matter, irrespective of its nature or complexity. Equally appreciable was the commitment of the Vacation Bench, which continued sitting till every matter in the cause list had been heard. When the matter was finally called, the Court immediately understood both the issue and the urgency involved, granted relief, and disposed of the petition. Days like this remind us that litigation is not only about arguments and preparation, but equally about patience and perseverance. Rethinking the “Trial Court First” Rule in Litigation I’ve never really believed in the idea that an advocate has to follow a fixed ladder from trial courts to the High Court and then the Supreme Court. That may work for some, but it’s not the only way to build a meaningful practice. I still remember what my Senior told me during my internship in the final year of law. He said, "water flows from the top to the bottom". That thought stayed with me. When you expose yourself early to the standards of the Supreme Court, it changes the way you think, prepare, and present. Your confidence builds differently, and your understanding of law sharpens much earlier. At the same time, we’re in an era of specialisation. There are advocates who consciously want to work on the constitutional side and grow as constitutional lawyers. In that context, does it really make sense to insist that everyone must spend five or more years only at the trial court level?? I’ve also seen the other side. During a brief internship in a district court chamber, there were advocates with 7 to 10 years of experience who were still confined to juniorship, without having had the opportunity to advance substantive arguments. For many of them, even stepping into the High Court felt like a big leap. That kind of prolonged restriction can quietly affect confidence and limit one’s sense of possibility. There is no legal bar that confines an advocate to any one forum. The profession allows you to be versatile, to appear across courts, and to shape your own path. For me, that early advice made all the difference. It pushed me to not wait for a prescribed timeline and to step into spaces that seemed “too early” by conventional standards. And looking back, I can say with clarity that one approach cannot work for everyone. Clarity builds confidence — and in the legal profession, trust is everything. One of the most underrated aspects of advocacy is transparency in the advocate–client relationship. Many disputes, misunderstandings, and dissatisfaction don’t arise from outcomes, but from lack of communication and clarity during the process. In my experience, a few simple practices can make a significant difference: • Clear fee structure from the outset – no ambiguity, no surprises later. • Sharing draft petitions/pleadings before filing – the client has a right to know what is being stated on their behalf and to give inputs where necessary. • Providing filed copies promptly – once a matter is filed, the client should have complete access to the final documents. • Encouraging clients to follow proceedings – whether through virtual hearings or physical presence in court, it builds confidence when clients see how their matter is being argued and handled. These are not just professional courtesies — they are essential elements of ethical and responsible practice. An informed client is not a difficult client; in fact, they are more understanding, more cooperative, and more trusting of the process.
