I've cried enough tears to fill up a swimming pool, but I'm picking up trash today for my Adopted Highway. My truck was worth 22K when they repossessed it but they sold the truck for 14K (at 65% of Fair Market Value), then sued me in Court for $18,589.35 (26CV000139-780). Under the UCC, they're supposed sell the truck at public auction, and if the sales price is still too low, they're supposed to calculate the deficiency balance using FMV, not the low price they used to sell the truck to themselves (self dealing). The UCC 9-626 and the NCGS 25-9-626 say they have "burden of proof" to show that they sold my repossessed truck in a "commercially reasonable" manner. After admitting that the truck was sold below fair market value, they refused to provide proof they had followed the UCC law. When I asked them to prove they owned my alleged debt of 18K, they filed a Protective Order to silence me about the backdated contract from Santander they used for legal assignment (potential violation of Federal Securities and Commodities Fraud Statute 18U.S.C.§1348). For over three months, they made misrepresentations in court filings that they refused to correct and repeatedly violated the Federal Rules of Civil Procedure, but they still persisted in their meritless claims just to WEAR ME DOWN. So yesterday, I had to file a MOTION FOR RULE 26 AND RULE 37 SANCTIONS. The powerful Mandarich Law Firm, LLP is suing me with debt collector NCB Management Services, Inc., for a truck that Santander reposessed after charging me 18% interest rate from the start, then selling the truck cheap to themselves at 65% FMV, and now they want me to pay $18,589.35. They are rich and powerful, but they have to follow the Laws too (UCC, NCGS, USC, FRCV, Consent Judgment by State of North Carolina and Joshua Stein v Santander Consumer USA Inc. 20CV5917) The Motion for Rule 26 and Rule 37 Sanctions Court Hearing will be held on July 8, 2026 at 10AM with Judge Scott Skidmore at the Rockingham County Courthouse.
