NIPIGON OPP ARREST SUSPECT IN BREAK & ENTER AT HARKNESS STREET LOCAL FAKE NEWS REFUSE TO TELL PUBLIC AGAIN Ontario Provincial Police Officers in Nipigon responded to a call for a break & enter last evening, May1/26 at 123 Harkness Street. Officers located the male suspect and arrested him. They learned the suspect had been released on bail on Nov19/25 with a curfew of 10pm to 6am. Officers noticed damages to the door of the home. A 25y/o BRADY JOHN BRADLEY BORG (Jan23/01) is criminally charged with: -break & enter -mischief under $5000 (door) -breach of bail BORG has been transported to the Thunder Bay Jail & has a court appearance scheduled this upcoming week. FINAL SUBMISSIONS IN TRIAL OF FORMER THUNDER BAY POLICE LAWYER JUSTICE ROBERT GOLDSTEIN EXPECTED TO HAND DOWN JUDGEMENT ON FRIDAY APR24/26 A 39y/o HOLLY ALEXANDRIA WALBOURNE (Dec10/86) appeared in the Superior Court of Justice today, Apr21/26 before Justice Robert Goldstein to hear final submissions in her trial WALBOURNE is the former lawyer for the Thunder Bay Police Service who was criminally charged following an investigation by the Ontario Civilian Police Commission (OCPC) WALBOURNE is facing only two criminal charges now. -obstruct justice -breach of trust WALBOURNE has been acquitted of one other charge last week. Provincial Crown Attorney Samuel Walker highlights the evidence of the Crown’s six witnesses and numerous exhibits. He asserts that TBPS Deputy Chief Ryan Hughes is highly credible and his evidence is not challenged. WALBOURNE was informed by phone from HUGHES of the criminal investigation into former TBPS Board Chair Georjann Morriseau between Nov10/20 & Nov19/20 Former Chief Hauth’s notes from Oct15/20 indicate the criminal investigation is underway and she would bring in HOLLY. WALBOURNE was made aware in a meeting on Nov30/20 that the interview with JASON RYBAK by Dan Irwin had already occurred on Nov26/20 and TBPS Officer Graham Forshaw had already applied for a criminal Production Order on MORRISEAU’S phone. WALBOURNE was further notified by email on Nov19/20 of the alleged wilful obstruction by MORRISEAU. WALBOURNE set up a phone call on Dec8/29 to Toronto lawyer David Humphrey. WALBOURNE’S statement to the OCPC that she wasn’t aware of a criminal investigation into MORRISEAU until Dec9/20. WALBOURNE stated that she was surprised, shocked & outraged on Dec9/20 to learn of the criminal investigation. TBPS Computer records show that WALBOURNE had accessed the occurrence reports created by Deputy Chief Hughes prior to Dec9/20. The reports clearly show WALBOURNE had many months to prepare for OCPC investigation and did not tell the truth to Ian Scott of the OCPC in March & May of 2022. Defence Attorney Frank Addairio submits that the Crown has not proven beyond a reasonable doubt that WALBOURNE is guilty. He argues that memories have faded over the years and that WALBOURNE did not intentionally mislead OCPC. The Mens Rea (Guilty Mind) is not present. ADDAIRIO further submits that WALBOURNE reached out to Toronto lawyer David Humphrey thinking it was just a Police Service Act investigation. He suggests that because HUGHES needed to use his notes to refresh his memory. His note taking is unorthodox because he kept a second set of notes and did not take notes of his conversation with WALBOURNE Defence Attorney Nicola Langille submitted to His Honour that WALBOURNE was not acting in her official capacity when the interview with OCPC occurred and she should not be held criminally responsible. She argues that WALBOURNE did the right thing by seeking outside legal advice from David Humphrey shows she did the right thing. It’s further submitted that “micro-inaccuracies” are not evidence of obstruction or misleading. His Honour had a lot of questions for both counsel during submissions. Justice Goldstein is expected to review all the evidence and issue a decision on Apr24/26.

On Oct13/21, HUGHES expressed to HAUTH that the memo she sent to the board was false. HUGHES sent an email to HAUTH on Oct14/21 highlighting previous emails he had sent to HAUTH and contradict HAUTH’S memo to the TBPS Board. He suggests amending the memo to reflect the truth or attending the Board meeting to explain. HAUTH responded by email to HUGHES and said she will review and they will discuss. An in person meeting between HUGHES & HAUTH occurs later that day & HAUTH confesses that she didn’t remember the previous communications from HUGHES. HUGHES tells her the memo sent to the board is incorrect. HAUTH suggests to HUGHES “Let it play out and see if the Board catches it” The memorandum to the TBPS Board unfairly blamed Deputy Chief Ryan Hughes for the MORRISEAU investigation. Deputy Chief Hughes was suspended on Jan8/22 in relation to the Mike Dimini & Holly Walbourne matter, related to a workplace harassment investigation. He was reinstated in February 2023 with no charges of findings of misconduct. DEFENCE CROSS EXAMINATION OF RYAN HUGHES HUGHES testifying that he never knew it was a Conflict of Interest to investigate a member of the TBPS Board. He now knows that he can’t use a Criminal Code Production Order to conduct a Police Services Act investigation. That was beyond his expertise. An email on Nov19/20 from WALBOURNE to HAUTH & HUGHES expresses concern that TBPS Board Chair MORRISEAU is not cooperating with the investigation. WALBOURNE states that the TBPS Board should be advised and says she will draft a memo. She never explicitly states that a criminal investigation of Morriseau should be initiated. HUGHES agrees that he created an occurrence report that only he & the Chief had access to on the same day. On Nov25/20 HUGHES made notes regarding the investigation that only he, HAUTH & one civilian staff, ALYSSA FUTIA were aware of. HUGHES sends an email to HAUTH on Nov27/20 advising her of the status of the MORRISEAU investigation HAUTH sent a request to the OPP for them to do the investigation into MORRISEAU, but HUGHES told Ian Scott of the Ontario Civilian Police Commission (OCPC) that he had never explicitly been told to stop by Chief Hauth. HUGHES was not privy to any conversations between HAUTH & WALBOURNE prior to issuing the memo to the board and cannot testify to what was discussed between them. HUGHES is done testifying and court is stood down until tomorrow, Apr16/26.

FOURTH WITNESS OF THE TRIAL: TBPS DEPUTY CHIEF RYAN HUGHES HUGHES testifies he has spent 27 years as a Police Officer. Prior to that, he spent 6 years with the Coast Guard. HUGHES worked numerous positions at TBPS, from Constable to Detective Seargeant, Staff Seargeant, Inspector and ultimately Deputy Chief in August 2019 HUGHES oversees Criminal Investigations, Uniform Patrol & Community Services or as the TBPS Chief directs. He also oversaw Professional Standards branch (internal investigations) HUGHES was the only Deputy Chief at the time. There are now two Deputy Chiefs at TBPS. One is operational, the other is administrative. HUGHES never worked with Sylvie Hauth as a constable. He was a Detective Constable and she was Seargeant was his first experience working with HAUTH. When he became an Inspector, HAUTH was acting Deputy Chief supervising HUGHES. HUGHES testified it was never a strong relationship with HAUTH. Things began to dissolve or erode around 2020. WALBOURNE was hired in January 2018. He understood WALBOURNE to be counsel to Chief of Police. WALBOURNE would assist with misconduct investigations amongst TBPS Officers. Other lawyers would be contracted, but WALBOURNE was the only “in house” lawyer at TBPS. HUGHES worked a lot with WALBOURNE in 2018 and had a strong professional relationship. In 2020 the relationship became strained regarding an incident on Frederica Street with Mike Dimini. In 2021, the working relationship between HUGHES & WALBOURNE fell apart. HUGHES would brief HAUTH on numerous issues, but was told that everything must also go through HOLLY WALBOURNE. HUGHES kept notes throughout his career as required by law. He felt he was being targeted by senior administration and kept some separate notes because he thought his original notes might be seized by the Chief. He will bring in those notes tomorrow & supply a copy to Defence. Inspector Fennell was in charge of a criminal investigation into alleged leaks to the infamous Thunder Bay Courthouse -Inside Edition Facebook Page. Member of the Break Enter & Armed Robbery (BEAR) unit were told to keep the investigation quiet. Another investigation was started regarding TBPS Board Chair Georjann Morriseau and the unknown police officer who approached her at Home Sense. There was some talk of that Police Officer being Seargeant Jason Rybak. MORRISEAU phoned Deputy Chief HUGHES on Oct2/20 complaining the TBPS investigation was going too slowly. HUGHES went on medical leave on Oct19/20 for a medical leave. First two weeks he didn’t look at computer or take calls. But after that he began responding. Chief Hauth did not designate a replacement for him. He continued to communicate with her via email. On Nov10/20, Detective JASON RYBAK contacted HUGHES saying he doesn’t know why his name was brought up and he was concerned & agitated. RYBAK did not tell HUGHES how he knew his name was brought up. HUGHES has suspicions that MORRISEAU told RYBAK and told him so. RYBAK would not confirm. However HUGHES knew that MORRISEAU was aware of RYBAK. HUGHES contacted WALBOURNE regarding this investigation. MORRISEAU was not cooperating with the Thunder Bay Police on the investigation. This may possibly be an obstruct police investigation. The words Conflict of Interest never arose and HUGHES was never discouraged from investigating. WALBOURNE emailed HAUTH & HUGHES on Nov19/20 stating TBPS Board Chair MORRISEAU was not answering phone calls and was now actively obstructing a police investigation. WALBOURNE would draft a letter to the TBPS Board letting them know what has occurred. Deputy Chief Hughes emailed Police Chief Hauth on Nov23/20 and advised that Detective Jason Rybak confessed that MORRISEAU had given him the information. Court closed for the day and HUGHES will resume testifying tomorrow, Apr15/26
