DEMAND FOR SAFETY IN DURGANAGAR BLASTINGS
CONSTITUTIONAL RIGHTS OVER CONTRACTOR CONVENIENCE ⚖️
The Law is Clear:
Public Safety is Not Negotiable!
In Durganagar, canal excavation is occurring less than 50 meters from residential homes. Using heavy explosives at this distance is a direct violation of mandatory safety protocols designed to protect Indian citizens.
STOP THE HAZARDOUS BLASTING IMMEDIATELY
The use of police force to continue blasting despite legitimate safety resistance from residents is a grave concern. Such actions bypass critical protections under:
CPCB (Central Pollution Control Board) Norms: These mandate strict vibration and noise buffers for any activity near residential areas.
PESO (Petroleum and Explosives Safety Organization) Standards: These prioritize public safety and structural integrity in the use of explosives.
Explosives Act 1884 & Explosive Rules 2008: These laws require absolute safety for surrounding structures; if safety cannot be guaranteed, the operation lacks legal standing.
THE ONLY LAWFUL PATH: CONTROLLED EXCAVATION
To protect the village, the contractor must adopt Non-Explosive Mechanical Methods that produce zero shockwaves.
We demand the exclusive use of:
Hydraulic Rock Splitters: These use lateral pressure to split rock internally with no vibration, no noise, and no fly-rock.
Chemical Expansive Methods (e.g., Dexpan): A silent agent that cracks rock through expansion, ensuring zero vibration and zero noise.
Choosing traditional blasting simply to save costs while residents endure "everyday torture" and structural damage is a violation of the Right to Life (Article 21).
Property rights and project deadlines cannot override the fundamental safety of human beings.
We look forward to the Hon’ble High Court upholding these safety norms and protecting fundamental rights on January 2nd, 2026.
