Federal Court reminder: choosing the wrong immigration representative can have serious consequences.
In Makhija v. Canada (Citizenship and Immigration), 2026 FC 743, a study permit applicant argued that a “ghost consultant” submitted a fraudulent GIC without his knowledge. The Court upheld the misrepresentation finding because the applicant failed to respond to IRCC’s Procedural Fairness Letter and the officer had no evidence of consultant misconduct before making the decision.
Key lesson: You are responsible for the contents of your application, even when someone else prepares it.
Always:
✔ Verify your representative is authorized
✔ Review all documents before submission
✔ Maintain access to your application email
✔ Respond promptly to IRCC requests

In this case, our consultant had a consultation in the year 2025 with a student who had been refused a study permit close to two years prior and was looking for potential solutions.
We determined that the refusal was unreasonable and suggested a reconsideration. We did it in the year 2025 and, now, close to a year later, the client received good news that their study permit extension had been approved.
The client now can either apply for the work permit or a new study permit by getting admission at a DLI. Many doors have now been opened for the client who was out of status and looking to go back.
We look for solutions when none appears in sight. We strive to provide meaningful representation through effort and research, where all doors appear sealed shut in one's face.
