Between June and October 2019, Equity Bank Credit Officer Ijuka Marvin and colleague Kamwebaze Caroline fraudulently transferred UGX 52,750,000 from customer Kobusingye Mercy's account using unauthorized journal vouchers. Seven years later, justice has formally arrived. But has deterrence?
🏷️1️⃣ Deterrence theory, formalized by Nobel economist Gary Becker in 1968, establishes one non-negotiable condition: the expected cost of crime must exceed its expected benefit when discounted by the probability of detection, prosecution, and actual punishment enforcement. Applied here, this calculus produces a deeply uncomfortable result.
🏷️2️⃣ The prosecution consumed seven years. Kamwebaze negotiated a plea bargain. Ijuka absconded in February 2026 when conviction became inevitable, exploiting four additional years of freedom. He remains at large. The money remains unrecovered. The victim remains uncompensated. For any rational actor observing this case, the system has communicated one unintended lesson: the crime can be gamed, and gaming it yields significant returns.
🏷️3️⃣ Kahneman and Tversky's Prospect Theory confirms precisely why this matters. Humans systematically underweight low probability future costs against high probability present gains. A sentence existing only on paper, against a fugitive whose location is unknown, is not experienced as a cost by potential offenders. It is experienced as a distant abstraction, discounted toward irrelevance.

Without mandatory restitution as a non-negotiable condition, the judicial process signals negotiability of punishment to future offenders, rewarding strategic engagement over genuine accountability. Meanwhile Kobusingye's UGX 52,750,000 remains entirely unaddressed, eroding victim reporting incentives and consequently reducing the detection probability that deterrence fundamentally requires.
🏷️5️⃣ Equity Bank's institutional silence is equally consequential. Two employees weaponized its own internal systems against a customer. Zero institutional consequence has been recorded, leaving the internal control failures that enabled the fraud structurally unaddressed.
🏷️6️⃣ The DPP's press release states that this conviction sends a clear message that individuals cannot evade responsibility by avoiding the judicial process. The difficulty is that Ijuka Marvin is, at this precise moment, doing exactly that.
🏷️7️⃣ The message sent is real. It is simply not the message intended. And in deterrence theory, it is always the message received that shapes behavior, not the message transmitted.
