Interesting- (1) Digital Collectibles v Galactus Funware (2023:DHC:2796) wasn’t cited it seems - so no discussion on the mythical “personality right” being rooted in some sanctioned law in India - Understable - given this is an ex-parte order. (2) Also interesting that the Suit proceeds purely on the publicity right as opposed to the basis of and claim being rooted in passing off. Although there are references to the elements of a passing off action, and the “torts of dilution and tarnishment”. This might put the plaintiff in a spot of bother - either on the entire suit claim or on individual claims. (3) How the Plaintiff sustains a claim on “456 songs unauthorisedly uploaded on to the AI Platform” since he wouldn’t retain any copyright in such sound recordings- is unclear. (4) The legal basis of training and consequences and defences and that individual users would select voices / personas for songs also not considered (CBS v Amstrad/ Sony Betamax). (5) Interesting that the Judge did not interrogate the Plaintiff as to the basis of clubbing disparate and seemingly unconnected Defendants in one claim. Interesting possibilities in this matter - that is if a defence is mounted.

📛🔥 Online Gaming Company challenges GST-levy on total amount pooled; Karnataka HC grants interim-relief ➡️ The Karnataka High Court granted interim relief to Mobile Premier League (MPL), challenging a GST demand on the total amount pooled, rather than just the Platform Fee (PF). ➡️ MPL argues that deposits not used for services should not be taxed as consideration under GST, and amendments to the Act affecting deposits should only apply prospectively from October 1, 2023. ➡️ An inspection by State GST authorities led to a memo, SCN, and Order, despite MPL's assertion that the deposited amounts do not constitute 'consideration' or 'aggregate turnover.' ➡️ MPL challenges the jurisdiction of the State Tax authorities to assess and tax them, claiming an error in construing the deposited amounts as 'aggregate turnover' based solely on their placement in a single account. ➡️ MPL contends that while the order acknowledges the platform hosts 'games of skill' (GoS), it unjustly applies valuation mechanisms from CGST Rules to indirectly impose taxes. ✔️ Karnataka HC - G Alactus Funware Technology Private Limited v. Court: He also seeks to distinguish the recent decision of this court in "DIGITAL COLLECTIBLES PTE LTD AND ORS. v. GALACTUS FUNWARE TECHNOLOGY PRIVATE LIMITED AND ANR" by arguing that in the said judgment, the case involved two competing gaming platforms where the defendant's business would have shut down if cricketers images weren't used.
