The white system has long sent black bodies to carry out the defeat of black collective demands when open white force would reveal too much. It keeps the white face for victory, authority, civility, judgment and historical authorship. It sends black intermediaries to do the dirty work of discipline, fracture and retreat. The black figure absorbs the political heat while the white institution preserves its manners.

Hmmm…
I AM grateful that Advocate Sikhakhane SC parked technical legal argumentation for this moral call. This needed to be said in plain English.🇿🇦
I served my 2 year articles of clerkship at Deneys Reitz Attorneys, (Norton Rose Fulbright SA in this matter) in 2004-2006.
I have never experienced the level of seniority bullying and professional frustration that I experienced at a *top law firm* in any other industry - I had worked in before.
The SC makes an apt reference to “living corpses” that emerge from untransformed RSA BIG law firms.
Gratitude: I am forever indebted to Mr Pierre Naude, Aviation Lawyer - for the respect, technical training and mentorship he accorded me during my rotation as his candidate attorney.
I recall his immediate support when I was not retained.
He walked from his office to my 4th rotation office. Shut the door. Sat down and told me, “You are a good lawyer. How can I help you to get a Human Rights placement?”
He wrote me a glowing letter of reference and kept in touch - especially when I was diagnosed with breast cancer.
(Ethical Meneer! Great human being🇿🇦📚👩🏽🎓🙏🏾)
Ps. A former black woman Associate is currently litigation against them in the Labour Court for corporate bullying and alleged racial discrimination , law.com/international-editio…#LegalSectorCode🇿🇦🇿🇦🇿🇦
2/..Today’s order:
Black Lawyers Association (BLA) and National Association of Democratic Lawyers (NADEL) take the floor.
They will first set out exactly how the absence of the LSC will directly harm their members - the majority of whom are Black lawyers - in ownership, management control, skills development and access to opportunities.

Ngcukaitobi’s role in this case forces a harder question than the noise around his appointment allows. Can a black advocate of his stature stand against a movement for black transformation in a profession that still locks most black lawyers out of meaningful economic power and still be received as the uncomplicated face of transformation? #Ngcukaitobi#legalsectorcode#AdvSikhakhane

Advocate Muzi Frederick Sikhakhane SC ;
is a refined and well processed legal jewel . We stand in full and unwavering support of the Legal Sector Code .

3/..Sikhakhane acknowledged there may have been imperfections in the Legal Sector Code process.
But the stats show deliberate exclusion for decades - even after B-BBEE.
In this very room, he noted, there is not a single black senior counsel.
And not because they are not talented.

‼️Big Law Vs Transformation
"This case is about existence and dignity”
In the Pretoria High Court today, Adv Muzi Sikhakhane SC pointed to the gallery - filled with black lawyers and members of the legal fraternity.
“This case,” he said, “is about their existence and dignity - not about mechanics.”
Those who are privileged deal in mechanics. The excluded fight for their very place in the profession.

2/..Big Law vs Transformation: Marginalisation = Social Death
Adv Sikhakhane is not mincing his words..
"Marginalisation and exclusion - which is what this case is about - leads to social death and mental disintegration, the same way physical starvation leads to death."
This isn’t abstract legal jargon. It’s reality for many black lawyers still on the outside.

Advocate Matseleng Lekoane, of Basadi ba Molao, tells the court women in law will continue leaving practice due to lack of transformation. She says many left because of lack of work opportunities.
#LegalSectorCode@BDliveSA
#LegalSectorCode: Advocate Terry Motau, representing Advocates For Transformation, argues the legal sector code is a first step to breathe life to transformation of the legal profession.

🚨BIG LAW VS TRANSFORMATION: LPC Drops Truth Bombs in Court!‼️
"No Catastrophe - This is a Very Fair Code."
Adv Bokaba for the Legal Practice Council hit it out the park today.
LPC referred to a Zwanaka Holdings report that completely dispels the doomsday claims by Big Law applicants. The sky is not falling.
Transformation is not destruction.
The new Legal Sector Code #LSC is fair, consultative, and long overdue to address the imbalances of the past while keeping the profession strong.
Big Law had their say.
Ministers of DTI and Justicehad their say
And Now the regulator is setting the record straight.
South Africa’s legal profession can - and must - reflect the country it serves.
Transformation done right = No catastrophe. Just progress. ✅
