ਮੌਜੂਦਾ ਸਮੇਂ 'ਚ ਔਰਤ ਅਤੇ ਪੁਰਸ਼ ਸਾਥੀ ਦਰਮਿਆਨ ਮਤਭੇਦ ਪੈਦਾ ਹੋਣ 'ਤੇ ਔਰਤਾਂ ਵਲੋਂ IPC ਦੀ ਧਾਰਾ-376 ਤਹਿਤ ਬਲਾਤਕਾਰ ਲਈ ਦਿੱਤੀ ਜਾਣ ਵਾਲੀ ਸਜ਼ਾ ਦੇ ਕਾਨੂੰਨ ਯਾਨੀ ਕਿ ਐਂਟੀ ਰੇਪ ਲਾਅ ਦਾ ਇਕ ਹਥਿਆਰ ਵਜੋਂ ਦੁਰਵਰਤੋਂ ਕੀਤਾ ਜਾ ਰਿਹਾ ਹੈ। ਇਹ ਟਿੱਪਣੀ ਉੱਤਰਾਖੰਡ ਹਾਈ ਕੋਰਟ ਵਲੋਂ ਕੀਤੀ ਗਈ। ਜਸਟਿਸ ਸ਼ਰਦ ਕੁਮਾਰ ਸ਼ਰਮਾ ਦੀ ਸਿੰਗਲ ਬੈਂਚ ਨੇ ਇਹ ਟਿੱਪਣੀ ਇਕ ਮਾਮਲੇ ਦੀ ਸੁਣਵਾਈ ਦੌਰਾਨ ਕੀਤੀ। ਇਸ ਮਾਮਲੇ 'ਚ ਇਕ ਔਰਤ ਨੇ ਆਪਣੇ ਸਾਬਕਾ ਸਾਥੀ ਵਲੋਂ ਉਸ ਨਾਲ ਵਿਆਹ ਤੋਂ ਇਨਕਾਰ ਕਰਨ ਮਗਰੋਂ ਉਸ 'ਤੇ ਬਲਾਤਕਾਰ ਕਰਨ ਦਾ ਦੋਸ਼ ਲਾਇਆ ਸੀ। ਹਾਲਾਂਕਿ ਸੁਪਰੀਮ ਕੋਰਟ ਨੇ ਵਾਰ-ਵਾਰ ਇਸ ਗੱਲ ਨੂੰ ਦੋਹਰਾਇਆ ਹੈ ਕਿ ਇਕ ਪੱਖ ਦੇ ਵਿਆਹ ਤੋਂ ਮੁਕਰ ਜਾਣ ਦੀ ਸਥਿਤੀ 'ਚ ਬਾਲਗਾਂ ਵਿਚਾਲੇ ਆਪਸੀ ਸਹਿਮਤੀ ਨਾਲ ਬਣਾਏ ਗਏ ਸਰੀਰਕ ਸਬੰਧ ਨੂੰ ਬਲਾਤਕਾਰ ਕਰਾਰ ਨਹੀਂ ਦਿੱਤਾ ਜਾ ਸਕਦਾ। ਉੱਤਰਾਖੰਡ ਹਾਈ ਕੋਰਟ ਨੇ ਟਿੱਪਣੀ ਕੀਤੀ ਕਿ ਔਰਤਾਂ ਮਤਭੇਦ ਪੈਦਾ ਹੋਣ ਕਾਰਨ IPC ਦੀ ਧਾਰਾ-376 ਦੀ ਦੁਰਵਰਤੋਂ ਕਰ ਰਹੀਆਂ ਹਨ। #UttarakhandHighCourt #Women #Misusing #Section376 #Jagbani
