The Consumer Grocery Pricing Fairness Act is a critical law to protect citizens who need affordable groceries AND independent grocers, both of whom are getting beaten up by big chains. The law would enshrine in New York what has been federal law for a century, but hasn't been federally enforced (with a brief moment during Lina Khan's tenure as the exception). Walmart will try to tell people that they have an impossible choice -- either cheap food or community-access and independent grocers--but after a recent lawsuit was released through the work of @ilsr, recent research by Asil Aslihan, and some powerful truthtelling by @NSAGLOBAL and @ActionYama and others, the game is up. Its clear they are using their power to manipulate prices and bully out competition so they can hike prices more. The coalition around the Consumer Grocery Pricing Fairness Act is growing. Terrific work by @SenatorCCleare and @MicahLasher to build the support to get it passed in New York!

A new investigation revealed that school districts and local governments are reportedly overpaying for supplies because of Amazon contracts that bind them to dynamic pricing. Rather than allow for competitive bidding, the deals “covertly raise prices and inflate costs for governments.”

One of the last cases we filed charged that Pepsi schemed with Walmart to hike prices at the grocery store and punish retailers that wanted to offer people dealing with inflation a better price. This new @FTC nixed the case and tried to hide the allegations. Grateful to @ilsr for getting the complaint unsealed and shedding light on this key issue.

1. ILSR has filed a motion in federal court to unseal the FTC’s antitrust complaint against PepsiCo. The case bears directly on high grocery prices & food deserts—and would've marked a crucial revival of the neglected Robinson-Patman Act. But the public may never get to see it.

This is why we have to fight back against sealed filings. They are used to hide conduct whose impact goes far beyond the parties to a lawsuit. We now know Pepsi is accused of far worse than just “sweetheart deals” for Walmart. The two companies are accused of a scheme that intentionally drove up prices for competitor retailers AND their customers. The alleged goal was to increase Walmart’s “price gap” and prevent customer “leakage” through an “aligned commercial strategy.” It was deployed against retailers as large as Target and Kroger. At a time when Americans are struggling with affordability in nearly every facet of their lives, it is a shame that this case fighting higher prices was dismissed in the dark. Hats off to @stacyfmitchell, @ilsr, and my co-counsel @amandalws for bringing the sunshine. Here’s one choice paragraph. Link to full complaint below.
A judge ordered the release of the unredacted price discrimination lawsuit filed by Chair Khan against Pepsi (and killed by the Trump-Vance FTC). This lawsuit was seeking to stop illegal business practices that raise prices for Pepsi products at every retailer besides Walmart. It is very likely that the companies are still doing this. I wonder, now that pretending to care affordability is in vogue for the GOP, if they regret spiking this one?
