If your policy idea sounds nice in the abstract but doesn't take into account implementation challenges, second-order effects, or the possibility of unintended consequences, then it's actually a bad idea. Even more so if it violates individual rights.

Life imitates game theory. Here’s a true story: I’m flying into New York from Paris today, and Rebecca is going in from Boston. We’re looking forward to a day of walking around the city, with no particular destination. But we almost missed each other’s calls last night and could have arrrived without having set a rendezvous place and time. I swear this really almost happened. Fortunately we know our Thomas Schelling (I wrote about the rendezvous game in When Everyone Knows That Everyone Knows….). For those who don’t: Where would we have met?

Is a PBM merely a vendor selling services to an employer, or is it an agent exercising delegated authority over the employer's pharmacy benefits?

Everybody seems to hate Pharmacy Benefit Managers (PBMs) right now. But how are they *actually* using force or fraud against pharmacists or employers or consumers, and not just clout? A first thought might be to say that PBMs are violating their fiduciary duty. But that's weak because PBMs are not automatically fiduciaries in the way that trustees and lawyers are. If an employer agrees to contract terms that let the PBM do all the various bad stuff (rebates, spread pricing, etc.), then that's a dead end. The PBM can say that it never promised to act solely in the employer's interest. BUT I wonder if you could rightfully argue that the employer was induced into the relationship under false pretenses. For instance, if you went back through the sales communications and all the PBM people were saying "We work for you" and "We negotiate the best prices on your behalf," seems like you'd have a foot in the door for arguing fraud, which I assume could nullify the contract. To me, putting the focus there is better than playing whack-a-mole with all the different practices. @SenWarren @HawleyMO @mcuban
