No, it is YOU who are wrong Daily Telegraph. The Gender Recognition Act 2004 - actual law - very clearly states that trans people must be fully treated as the sex they transition to β€œFOR ALL INTENTS AND PURPOSES.” We are legally recognised as the sex we transition to. The norm across Europe. @TheGreenParty is correct. The idea Labour passed the GRA 2004 and then just six years later passed a Bathroom Bill banning trans people - with no public announcements and in contravention of the court case they’d just lost - is ludicrous. The EHRC Code of Practice. This Is Not New. We Have Seen It Before. @EHRC @UKLabour @LGBTLabour @bphillipsonMP The new EHRC Code of Practice promotes exclusion rather than inclusion. It creates a situation where transgender people, non-binary people and many intersex people can be excluded from spaces they have used safely for years. It places employers, businesses and public services under pressure to abandon inclusive policies that have worked successfully across the United Kingdom for decades. History does not look kindly on policies that separate people from public life based on who they are. We have been here before. Multiple times. The pattern is always the same. A group of people is identified. A reason is found to exclude them from certain spaces, certain rights, certain protections. The language of safety, order and common sense is applied. Institutions enforce the division. Years later the people who built those walls are remembered for exactly what they were. Jim Crow laws in America enforced the separation of Black and white people in public spaces. Separate bathrooms. Separate drinking fountains. Separate seats. The language used to justify it was the language of natural order, of protecting certain people, of common sense distinctions. The EHRC guidance telling transgender people they may be excluded from spaces corresponding to their identity uses remarkably similar language. Proportionate distinctions. Legitimate aims. Protecting certain spaces. The framing has changed. The logic underneath has not. Apartheid in South Africa built an entire legal architecture around the classification of human bodies. Pass laws. Designated areas. Separate facilities. People were required to carry documentation proving their classification and to use only the spaces assigned to them. The current situation where transgender people face questions about their documentation, their bodies and which spaces they are permitted to occupy echoes that architecture in ways that should make everyone paying attention deeply uncomfortable. Nazi Germany began not with extermination but with exclusion. Laws removing Jewish people from public life. From professions. From spaces. From legal recognition. Step by step. Each step described as reasonable. Each step justified as protection of something. Each step building on the last. The Lemkin Institute for Genocide Prevention has issued a formal Red Flag Alert about the conditions facing transgender people in the United Kingdom. This is not a casual warning. This is a formal assessment from an institution that exists specifically to identify the conditions that precede mass human rights violations before those conditions become irreversible. The United Kingdom is the only country in Europe on which this alert has ever been placed. The Institute’s analysis identifies the interaction between legal exclusion, healthcare removal and social marginalisation as compounding conditions that follow a documented historical pattern. That pattern has a name. We know what it looks like. We know where it leads. The British government’s position on transgender healthcare, legal recognition and the EHRC Code of Practice should not survive serious scrutiny. Not political scrutiny. Not media scrutiny. Scientific and legal scrutiny. The kind that requires evidence to be placed in front of a judge and defended honestly against the full body of research that the government has chosen to ignore in producing these policies. The Science They Are Refusing to Defend in Court Transgender people exist because of documented biological processes that occur before birth. The genitals and the brain develop in separate windows on different hormonal timelines in the womb. When those environments differ the result is a person whose neurological identity does not match the sex they were assigned at birth. This is embryology. It is peer reviewed. It is published across decades of independent research in multiple countries.
