This is a metaphysical error, e.g., it assumes that what can be done to a thing, determines what that thing is.
But the ontological existence of a thing is determined by it's hyle (substance) and morphe (form). Thus, an embryo and a neonate a hylomorphically the same thing.
That is, both have the hyle of human, and the morphe of an individual of the species homo sapiens.
