You should really watch all of this incredibly detailed reporting on many of the problems we've seen in long term care for the past decade. There is work to be done, but stories like these shining a light on the problem are so helpful. Grateful to Taylor & @fox13 for this effort.
For months, I've been reporting on gaps in Utah's elder care systems at @fox13. I've read thousands of pages of inspection reports, interviewed nearly 20 people on camera across all aspects of the industry and read dozens of police reports & lawsuits.

Check out our latest blog post to learn more about how artificial intelligence is shaping decisions about Medicaid and healthcare services and what’s at risk for people with disabilities as the federal government cracks down on states’ ability to regulate AI: bazelon.org/ai-regulation-is…

🚨BREAKING: the White House announced at 4:45pm ET signing ceremony today for what we expect to be the executive order on AI preemption. For those not in the loop: the order would block states from adopting their own AI safeguards and centralize all regulatory authority at the federal level. This would create real risks for people with disabilities, as states have been the first movers on addressing algorithmic bias in healthcare and public benefits; preempting them leaves people with disabilities with fewer avenues for recourse when automated systems get it wrong.

We've long advocated for guardianship reform, despite pushback from policymakers. These stories show several of the problems. Guardianships are often granted when they shouldn't be, conflicts of interest frequently arise, & oversight is lacking, which harm Utahns w/ disabilities.

While there are times when a full or limited guardianship may be necessary/appropriate, they should be limited to those circumstances & alternatives should be tried. We also must ensure guardians are not harming anyone under their care/take action against those who are.

A lack of community-based services for those w/ SMI, & no State plan to expand them, means forced treatment/institutionalization is the long-term proposed solution, returning us to the age of warehousing people w/ disabilities in segregated settings. That is not compassion.

There's nothing special or novel about institutionalizing/forced treatment of people w/ disabilities. It's not about hope or healing. It's another example of Utah choosing to fund institutions over community-based services/not support self-determination of Utahns w/ disabilities.
