Love to see ppl digging into to how censorship and privacy interact in consensus protocols! An important take-away for Zcash design: if miners censor all shielded txns, they would be preventing themselves from receiving their own mining revenue!
I believe you are asking if miners (more generally block producers) can discriminate between shielded vs transparent transactions: yes. Zooko is pointing out discriminating against "all shielded" is very different than fine-grained discrimination against specific users. Right?

4/ I'm beginning to think that building on chains that don't have base layer privacy will have pretty poor shelf-life. All the more reason to add programmability to protocols like Zcash, or build new networks with a mixture of Ethereum's flexibility and Zcash's privacy.

I think it's somewhat naive to think that any network where certain transactions can be identified as belonging to, e.g., North Korea will ever be able to carry on being censorship resistant. x.com/valkenburgh/status/156โ€ฆ

I'm getting that old feeling where I'm headed to school and still haven't done the homework for the day. Except the homework is base layer privacy for cryptocurrencies and the school is all the laws that will crush anything with censorship resistance but no privacy.

I used to think programmability should be L1 but moving funds privately into a L2 seems good enough. Keeps the base layer more simplistic.

Financial privacy should be the norm. People don't like getting their page views tracked by companies running ads - but don't realize their lack of privacy is so much worse in financial services.
