Failing to object is one of the weakest IAC arguments to make. This is because courts recognize there are strategic reasons you might not object - it could be opening the door to something else, you could not want to draw the jury's attention to it, you could not want to give the State the heads up to fix a problem, there's like a million reasons. So since courts won't find IAC where the decision could be strategic, that basically means if they can dream up any set of circumstances where there would be a reason not to object, the conviction is getting affirmed. To win a failure to object IAC claim, you pretty much have to show the issue is legally black and white and not objecting resulted in evidence that's dispositive of guilt. The only time I can remember winning it was the case where the attorney didn't object to testimony about the value of a stolen item when the testimony was rank hearsay - the cop googled some stuff online and then testified to what it said (like Cecil in the Richard Allen case). Whatever other issues there might be with attorney performance or pretrial rulings or anything like that, odds are very much against reversal for failure to object.
As I continue reviewing the trial testimony, I believe the Karmelo Anthony case has a strong chance of being overturned on appeal. The issue of ineffective assistance of counsel cannot be ignored. What is most striking is the defense's failure to object to numerous questionable and potentially improper questions posed by the prosecutor to several young witnesses. Defense counsel had a duty to zealously protect his client's constitutional rights at every stage of the proceedings. If those failures affected the fairness of the trial, appellate courts will likely take a very close look at the conviction. #BuckleUp
