While it appears that the government has successfully pushed back on some particularly harmful elements in the previous draft, the new Code of Practice will still lead to the exclusion of trans people from services and facilities that they have used without issue for a very long time. This will do nothing to improve women’s lives and the many struggles we face, but it will put trans people (and anyone perceived as trans) at increased risk of discrimination, harassment and violence. The Code unfortunately still represents the culmination of years of anti-trans campaigning from a small, well-funded minority who have had outsized influence in the media and in politics, and have weaponised the courts for their own ends. The legal situation for trans people is now deeply incoherent and means that it is untenable for them to be able live their lives with dignity. This is completely out of line with the values of equality that a Labour government is meant to champion. Instead of making this Code statutory, the government should be legislating to clarify and protect trans people’s rights, privacy and inclusion.

We are hugely disappointed by the transphobic language and policy points included in Scottish Labour’s manifesto released this week. As representatives of the LGBT community, trade unionists, and party members from across the labour movement, we condemn the Scottish Labour leadership's concession to reactionary, trans-exclusionary rhetoric, which stands in contrast to the views of Labour members and votes at Scottish Labour's Conference in 2025. These decisions constitute a severe error of judgment and failure to listen to trans voices within our party.

In Scotland, Labour supported the Gender Recognition Reform (Scotland) Bill through the Scottish Parliament before the Conservatives blocked it in Westminster in 2023. Scottish Labour's 2025 Conference rejected policy motions that would promote anti-trans segregation in education.

It was an honour to host the Trans Day of Visibility event organised by @Lab4TransRights and supported by @ASLEFunion, @CWUnews, @unisontheunion, @TransActualUK and @TransLucent_Org in Parliament this week. It was also fantastic to catch up with local groups @NottsTransHub, @NotTransphobia, and Nottingham Pastel Project. Trans people have always been part of the labour movement, fighting for the rights of all working people. Today, trade unions need to fight for them, especially as their workplace rights are under attack. By organising as rank-and-file members, the labour movement can put pressure on the Labour leadership to stand up for trans people.
