This is a smart idea, though I'd prefer 5-judge panels on the idea that it reduces randomness and, in turn, incentivizes advocates to lean into core arguments and away from idiosyncrasies.
I think one useful way to respond to the national injunction decision would be for Congress to expand the availability of three-judge panels to include matters seeking a national injunction. Also reform 3-judge panels to randomize them rather than having Chief Judge appoint.
