Judge Paul Kelly, president of the District Court, wrote to Roderic OโGorman 19 June warning that the suspension of the Child Law Project thatโs been holding the State to account since 2012 by monitoring court cases involving vulnerable children taken into state care by
@tusla was a โmost unwelcome developmentโ.
The project originally headed by
@CarolCoulter17 published a tranche of reports quarterly documenting some of the cases involving children taken into state care.

@IrishTimes reveals that Judge Kelly expressed his โgrave disappointment and concernโ at the withdrawal of funding for the project.
Judge Kelly said the project had shone a light into a โvery darkโ corner of the court system, covering child-protection cases that involved shocking and disturbing evidence. The
@ChildLawProject had provided โexcellent value for moneyโ at a modest cost to the State, he wrote.
The reports published by the project were of โimmense benefitโ to judges in the District Court and elsewhere, as well as lawyers, social workers, academics and policymakers, he said. โEven at this late, stage I ask that you reconsider the matter and provide the necessary resources to enable the project to continue what I feel is essential work,โ Judge Kelly said.
The current CEO of the project, Dr.
@MariaLCorbett wrote to OโGorman in May asking about the new tender to replace the current tender which expires in a few weeks. A reply from his department on the 30 July said the department was unable to provide a timeline for when the tendering process might begin.
Jack Power reports that the process of taking bids for the new contract has not yet started, and when it does it will likely take at least a number of months before funding is awarded.
The project is unlikely to resume in the lifetime of this government. Meanwhile, due to funding shortfall, the project has not sent researchers to observe court proceedings since the middle of this year and is due to publish a final report in the coming weeks.
There was consternation last year when the Project published a report on Judge Simmsโs letter 17 May 2023 sent to a number of State and public institutions, including
@rodericogorman in which he expressed the โutmost concern for the immediate predicament and welfare of children who are in careโ, drew attention to the placement of children in unsuitable (unapproved) special emergency residential placements (due to a lack of care placements) and called for โimmediate and coordinated actionโ to remedy the current crisis.

@Toibin1 discovered after he requested the information through a parliamentary question, that OโGormanโs Department deliberately destroyed three of the four reports sent by Judge Simms to the minister.
A statement from OโGormanโs department when news broke about the destruction of the judgeโs reports to the minister said: โFollowing consideration of the Departmentโs statutory responsibilities in relation to data protection, the Department formed the view that it did not have a legal basis to process the personal data contained in three of those four reports, and those reports were subsequently deleted from the Departmentโs records.โ
