باپ کی عدالت - چاچو کی حکومت اور میڈیا کے ٹٹو عدالتی اصلاحات متعلق پریس ریلیزوں کی بھرمار کے پیچھے بچے کی نوکری تھی؟ گو کہ چیف جسٹس یحییٰ آفریدی کے فرزند ایک بالغ اور خود مختار وکیل ہیں جنھیں اپنی زندگی کے فیصلے کرنے کا پورا حق ہے مگر پھر اُنکے اس کمیٹی میں شامل ہونے پر سوال اُٹھانا ہم سب کا حق ہے۔ کمرشل کورٹس بنانے کا مقصد کاروباری مقدمات کا جلد فیصلہ نہیں بلکہ ریاست کے کاروبار کو تحفظ اور توسیع دینا ہے۔ جب تک ریاست اور اسکے ادارے کاروبار کر رہے ہیں اسوقت تک کمرشل کورٹس کے ججوں کی حیثیت گھریلو ملازموں سے زیادہ کچھ نہیں۔ ریاستی کاروباری اداروں کیخلاف ان کمرشل کورٹس میں جانے کے لئیے درکار ہمت و حوصلہ مقامی سرمایہ کاروں کے پاس تو ہو گا نہیں۔ پیچھے رہ گئے غیر ملکی سرمایہ کار جو ریکو ڈک جیسے مقدمات میں ہماری سپریم کورٹ تک کو جوتے کی نوک پر لکھتے رہے ہیں۔ اربوں روپوں کی تنخواہوں اور مراعات کے باوجود کاروباری مقدمات کا التوا عدلیہ کی نالائقی اور ناکامی تھی جس پر سزا و جزا کی بجائے انکی مراعات بڑھا دی گئی ہیں اور ہر شعبے کی الگ عدالتوں کے نام پر عدلیہ کی یکجہتی کو جڑ سے اکھاڑ پھینکا جاُرہا ہے۔ کیا سیاستدان، کیا ججز اور کیا میڈیا سب کے سب دھندے پر لگ گئے ہیں اور طاقتوروں کی سیاست، اقتدار اور کاروبار کو تحفظ دے رہے ہیں۔ جس ملک میں ریاست کاروبار کی نیت سے فلاح کے نام پر غریبوں کی زمینیں اور چھت چھین رہی ہو اُس ملک میں کمرشل کورٹس کے بونے منصف انصاف کرنے کی جرات کیسے کرینگے؟ یہ نام نہاد کمرشل عدالتیں آرڈیننسوں اور جعلی اکثریت کی قانون سازی جیسی لعنت کا طوق گلے میں ڈال کر ریاستی لینڈ مافیا کے بلڈوزر کا کام کرینگی اور اس دوران بنیادی انسانی حقوق کا گلا گھوٹنے کی ذمے داری وفاقی آئینی عدالت کے طفیکیے ججوں کی ہو گی جو نئے آئین میں بغیر آئینی درخواست کے انسانی حقوق متعلق فیصلہ نہ دے سکنے کی مجبوری بتاتے ہیں مگر آئے روز اپنے ریمارکس کے ذریعے حکومت کی گندی پونچھل صاف کرنے کا کوئی موقعہ ہاتھ سے نہیں جانے دیتے۔
