Governor Gretchen Whitmer has appointed Indian-American community leader Mandeep Singh to the state’s AAPI Affairs Commission, representing over 300,000 Asian American and Pacific Islander residents. Let’s be clear…these attacks on our communities are not making us safer. This past week was horrible. Armed federal agents have been conducting high profile immigration raids throughout Los Angeles where it is estimated that up to 200 people have been detained. The Administration has deployed 2,000 National Guards into our city, directly confronting protesters exercising their First Amendment rights.— ICE has been waiting at local courthouses to detain people coming out of their court hearings. All this ‘to keep us safe.’ The Federal government might say they are targeting violent criminals, but these massive roundups lead to many others being attacked and detained without judicial warrants who are family members, friends, and co-workers. The detention centers are overcrowded and those detained are sleeping on concrete floors without sufficient access to basic needs and being denied access to legal counsel. Domestic violence victims are avoiding seeking restraining orders against their abusers for fear of being detained when they go to court The city of Los Angeles has always been and will always be a city of immigrants — as is this country. The events of the past week were blatant attacks on this fundamental truth. These raids are the result of two things: the failure of leadership to provide pathways to citizenship for undocumented community members and the inhumane persecution of innocent people under the false pretense of national security. We have received reports that Vietnamese, Laotian, and Cambodian community members were detained during their routine check-ins with ICE. Individuals who are affected include those who arrived in the U.S. before 1995 as refugees, were previously ordered removed from the U.S., and are required to check-in with ICE periodically under an order of supervision. This trend is contrary to long-established practices in which these community members would not be detained or deported, partly due to agreements between the U.S. and the governments of Vietnam and Cambodia. Under those agreements, these countries have significantly limited who they will accept for deportation, allowing many community members to remain in the U.S., stay with their families, and build their lives over the past several decades. If you have an upcoming check-in with ICE, or if someone you know has already been detained, please call us for a legal consultation. Preparing for an Upcoming Check-in with ICE: If you anticipate having any interaction with ICE, here are some steps you can take to prepare and protect yourself and your loved ones. Know your rights. 👉You have the right to remain silent and request an attorney. 👉You should not sign anything without legal advice. Prepare important documents. 👉Gather your legal documents, identification, and any paperwork related to your immigration and criminal cases. Keep them in a safe and accessible place. 👉Give a trusted person access to these documents so they may consult an attorney on your behalf if necessary. Consult with an immigration attorney. 👉Speak with a lawyer about your case and legal options. 👉Ask about any steps you can take to prevent detention or removal. You may be eligible for post-conviction relief or other immigration relief. Stay connected with support networks. 👉Reach out to local advocacy groups that support immigrant communities. 👉Stay informed about any changes in policies that may affect your case. Because this situation is evolving, ICE’s policies may shift again. In the last two weeks, ICE enforcement has been reported in various regions of LA and Orange Counties, including Macarthur Park, DTLA, Lincoln Heights, Boyle Heights, South Gate, Exposition Park, Pomona, Huntington Beach, Fullerton, and Garden Grove. The Trump administration has initiated its unconscionable plan to remove millions of immigrants living throughout our nation, employing aggressive ICE enforcement tactics targeting our homes, our workplaces, and public spaces. Now is the time to get prepared, stay vigilant and fight for your rights. Be aware that immigration agents may drive vehicles or wear uniforms that say “POLICE” but are not actually local law enforcement. If you’ve already filed for asylum, please do not give up on your case. The case processing timelines may be long, but there are important steps to consider. 1. Make sure to watch for USCIS notices for biometric appointments or to inform you that your case has been approved. These papers will have “Form I-797C, Notice of Action” printed in the upper right corner of the paper. Please show up for your biometrics appointment date noted on these sheets, and keep all these documents for your records. 2. Make sure you watch for USCIS Request for Evidence (RFE) letters, and respond to them by the deadline noted on them. A Request for Evidence is issued by the USCIS if they need more evidence or clarification before they can approve your case. Ignoring this can be fatal to your case. 3. If you have submitted your Asylum application and are in Removal Proceedings, you can continue to find proof of persecution in your home country or any other proof that may help your case. 4. Please note that you need to file for asylum within one year of your arrival to the U.S. If you are close to that deadline, file as soon as possible.
