One of the best things about law firm holiday parties is running into former students (not pictured) who are just killing it and can still name check the big briefwriting assignment 6-12 years later!
Competent appellate briefwriting is a learnable art not restricted to present or former members of the biglaw lawyers' club. Belief to the contrary is an illusion fostered by shame/prestige myths which permeate urban biglaw culture.

I write motions and appellate briefs for other lawyers. No way could I do my job effectively without having litigated in trial courts for some time. Skillful pitch selection is the most important part of briefwriting, and it develops out of trial court experience. In my opinion.
Twitter has necessitated a new defensive style of writing where you have to anticipate every possible argument, tangent, and exception related to what you’re tweeting and try to address all of them plus your original point in the tweet*.
It’s exhausting.
SOME of his advice is good. Some of it is quite bad.
He's at his best when he's talking about the craft of writing.
At his worst when he's talking about the mechanics of briefwriting.
I aspire to be a “swashbuckling Jew.” Somehow, “briefwriting Jew carving out an empire in his quest for new clients, appellate victories—and revenge” doesn’t have the same panache.
