Q: If a foreign nationalโs extension and work permit application is re-opened (for example, after judicial review), but a visitor record was issued through a restoration application in the meantime, can the person remain in Canada beyond the visitor recordโs expiry? Does the re-opening of the original application effectively override the restoration outcome?
A: Yes. Once the original extension/work permit application is re-opened and no final decision exists, the person again benefits from maintained status under R183(5) until a new decision is made. The expiry of the visitor record issued through restoration does not affect this maintained status. IRCC no longer uses the term โimplied statusโ and confirms this status is real, legal, and effective by operation of law.
