Prof. Welshman Ncube’s apology letter lists 12 cases that were either non-existent or did not support the propositions for which they were cited. The 1st Respondent (Andrew Zuze and others), represented by Advocate Thabani Mpofu, submitted their Heads of Argument in which they pointed out that multiple case citations by Prof. Ncube in the appellant’s arguments were either non-existent or defectively cited. It was the 1st Respondent’s legal team, led by Advocate Thabani Mpofu, who exposed the fake or defective cases by verifying the citations and showing they could not be found or did not support the claims. After this was revealed, Prof. Ncube said he checked and discovered that his unnamed researcher, whom he had assigned to find supporting case law, had used Artificial Intelligence to generate the citations without verifying them. Prof. Ncube admits that he himself failed to check whether the cases actually existed or matched the legal points made, an oversight he calls negligent and deeply embarrassing. Prof. Ncube has previously faced plagiarism allegations from fellow academic Lawrence Chuma. The dispute was settled out of court.
