𝗖𝗼𝘂𝗹𝗱 𝗞𝗲𝗻𝘆𝗮 𝗥𝗲𝘁𝘂𝗿𝗻 𝘁𝗼 𝗦𝗮𝗹𝗲𝘀 𝗧𝗮𝘅? It is an idea that periodically resurfaces in tax policy debates: should Kenya abandon Value Added Tax (VAT) and return to a simpler Sales Tax system? The question is not new. In fact, Kenya operated a Sales Tax regime from 1974 until January 1, 1990, when it was replaced by VAT following a major overhaul of the country’s indirect taxation framework. Announcing the transition in his 1989 Budget Speech, then Finance Minister Prof. George Saitoti argued that while Sales Tax had become an important source of government revenue, the economy had evolved to a point where its weaknesses were becoming increasingly apparent. As he noted: “Sales Tax as a source of revenue has become very important. However, as our economy has become more sophisticated, the many disadvantages of this tax have become more marked. I have over the last couple of months been considering a number of alternative reforms and I am now convinced that a fairly simple Value Added Tax system will give the necessary flexibility.” More than three decades later, some tax experts are revisiting that debate. Supporters of a Sales Tax argue that it would simplify compliance, reduce administrative burdens, lower disputes between taxpayers and the Kenya Revenue Authority (KRA), and potentially improve ease of doing business. VAT’s complexity stems largely from input tax claims, refund mechanisms, exemptions, zero-rated supplies, cross-border transactions and compliance requirements throughout the supply chain. A Sales Tax, by contrast, is generally collected at the final point of sale, making administration easier in theory. However, there is a reason why most modern economies moved away from Sales Tax and embraced VAT. VAT creates an audit trail throughout the production and distribution chain. Every supplier has an incentive to demand proper documentation from the previous supplier in order to claim input tax credits. This self-enforcing mechanism helps reduce tax evasion. A pure Sales Tax lacks this built-in verification system and can be more vulnerable to under-reporting at the retail level. The question therefore is not simply whether Sales Tax is simpler. The question is whether simplicity would come at the cost of revenue efficiency and compliance. For Kenya, where tax collection remains critical to financing government operations, infrastructure and public services, any move away from VAT would require careful consideration of its impact on revenue mobilisation, enforcement capacity and economic competitiveness. For now, a full return to Sales Tax appears unlikely. But the growing calls for VAT simplification suggest that the debate is far from over. Sometimes the most interesting policy discussions are not about introducing something new.
