Harvard's lawsuit is straightforward because the government's actions were straightforward. - - The government may not "interfere with private actors' speech to advance its own vision of ideological balance" (Moody v. NetChoice). The government demanded Harvard achieve "viewpoint diversity" in "each department, field, or teaching unit" (i.e. ideological balance). As Harvard notes, "the First Amendment makes clear that the authority to achieve that objective rests with the University rather than the Government." - - The government may not "rely[] on the 'threat of invoking legal sanctions and other means of coercion ... to achieve the suppression' of disfavored speech" (NRA v. Vullo). The government demanded censorship on condition of receiving federal funds, and President Trump explicitly said Harvard "teaches Hate and Stupidity, and should no longer receive Federal Funds" (i.e. viewpoint discrimination). - - The government "may not deny a benefit to a person on a basis that infringes his constitutionally protected interests" (Perry v. Sindermann). The government demanded Harvard give up its autonomy and First Amendment rights on condition of receiving federal funds. - - The government must follow a specific process in order to revoke federal funding under Title VI. It did not follow this process. - - Even if the government did follow the appropriate process, the funding revocations would need to be targeted "to the particular program, or part thereof, in which ... noncompliance has been found." Instead, the government's funding revocations were indiscriminate. In short, pretty much everything we at @TheFIREorg have said from the get-go.

Thai Lawyers for Human Rights on Friday reports that police from Mueang Phitsanulok Police Station arrived to search the office of American scholar Paul Chambers at Naresuan University without a search warrant yesterday. "They claimed that during a previous search, they had received consent from the university, thus giving them authority under the Computer Crime Act." The lawyer insisted that a court-issued search warrant was required, so the police left, said TLHR which represent Chambers who is charged with royal insult. The same police unit returned again at 4.30pm Friday and claimed to have coordinated with the Vice-Rector the university to obtain consent to check Chambers' old computer, which is the property of the university, without any written consent. "According to the Computer Crime Act, accessing any computer data where there is reasonable cause to believe an offense has been committed requires the authorized officer under the Computer Crime Act to obtain a court order first. However, the police who conducted the search did not present any court order. Furthermore, the investigative unit of Mueang Phitsanulok Police Station is not considered an authorized officer under the Computer Crime Act," TLHR noted. BREAKING: American scholar Paul Chambers, who was charged with royal defamation, was finally released by the Immigration Bureau in the middle of Wednesday night, Thai Lawyers for Human Rights confirmed shortly before noon today. TLHR said Chanbers' passport has been confiscated, and he was required to wear EM anklet to track his whereabouts. I loved being in India. My first time. I was shocked by how normalized Indians are to poor air quality. Breathing the air is like smoking multiple cigarettes a day. Yet no one wears a mask or has air filters in their indoor environments. The evidence shows that India would improve the health of its population more by cleaning up air quality than by curing all cancers. I am unsure why India's leaders do not make air quality a national emergency. I don't know what interests, money and power keep things the way they are but it's really bad for the entire country.

BREAKING The Phitsanulok Provincial Court has refused to grant bail for Dr Paul Chambers, a lecturer at Naresuan University's Faculty of Social Sciences. Chambers is facing charges of royal defamation and violation of the Computer Crimes Act. An arrest warrant was previously issued for him, but university administration requested that the police instead allow him to report to the police himself. He was taken to court today (8 April) after reporting to the police at Muang Phitsanulok Police Station. The Court subsequently denied him bail because his charges were severe. A court official told his lawyers to file for appeal. The lawyers said that they will be filing another bail request today and will be increasing the amount of cash security. They will declare to the Court that Chambers should be granted bail because he has a medical condition and that he is happy to follow conditions set by the Court, such as having a supervisor appointed and being required to report to the Court. If the request is still denied, the lawyers will be filing for appeal.

At 15.30, the Phitsanulok Provincial Court once again refused to grant Dr Chambers' bail request, despite his lawyers requesting that the dean of the Faculty of Social Sciences be appointed his supervisor. Thai Lawyers for Human Rights (TLHR) said that lawyers will be appealing the Court's decision tomorrow. Chambers will be detained at Phitsanulok Central Prison in the meantime.

Now, it is widely accepted that COVID-19 originated from that very lab in Wuhan, China. The 300 scientists were right when they said Anthony Fauci would start a global pandemic.
