UPDATE - Israel’s Supreme Court Rejects Dr. Hussam Abu Safiya’s Appeal The rejection of Dr. Hussam Abu Safiya’s appeal and his continued detention without charge represent a profound moral and legal failure. Rather than upholding the fundamental principles of the rule of law and due process, the court has endorsed the indefinite detention of a hospital director who remains in solitary confinement while suffering from medical conditions that are not receiving appropriate treatment. The message sent by this decision is unmistakable: a medical professional can be deprived of his liberty indefinitely without being charged and without the authorities presenting evidence against him in open court. Dr. Abu Safiya’s case is not an isolated one. It illustrates how judicial review proceedings for Palestinian detainees from Gaza have, in practice, become little more than a procedural formality. Every month, hundreds of detention review hearings take place, yet to the best of our knowledge they have not resulted in the meaningful reconsideration or revocation of detention orders—even in cases involving doctors and other medical personnel. We call for the immediate release of Dr. Abu Safiya and all other doctors who continue to be held without charge or trial.

New footage obtained by B’Tselem uncovers the moments when the Abu Haikal family was shot. Seven-month-old Sam Abu Haikal was killed in the shooting, and both his parents were injured. The footage clearly shows that the Israeli soldier fired at the car as it was slowing to a stop. The car was far from the soldiers and posed no danger to them whatsoever. Moments later, in another video obtained by B’Tselem, seven-month-old Sam’s father, Fahed, is seen just after his son was shot. Fahed is holding baby Sam in his arms, trying to stop the bleeding from his head with his hands, while Sam’s mother, Daniyah, who was also injured by the gunfire while holding her son, is seen sitting on the ground, next to the car. Last Friday, 5 June, an Israeli soldier fired at a Palestinian family driving home from a family visit, as they sat in their car in the Tel Rumeidah neighborhood in Hebron. The family was shot as the car was slowing to a stop at the soldier’s command. Sam, a seven‑month‑old baby who was in his mother’s arms in the back seat, was struck in the head and pronounced dead shortly afterward. Sam’s parents were also injured by the gunfire; his mother is still in the hospital. After the shooting, the soldier who fired and another soldier who was with him left the scene without checking the car or offering any assistance to the critically wounded baby or to his mother. In the past two and a half years, Israel has killed tens of thousands of children in Gaza and the West Bank. The immunity it gets from the international community has led to a reality where, under Israeli rule, Palestinian lives are entirely disposable – even a seven‑month‑old baby.

Locally employed doctors plug the gaps and keep services afloat, all the while being employed on insecure, short-term contracts. The new Eligibility and Permanency Framework will allow LEDs who meet the criteria to move to nationally recognised SAS contracts. Let’s be honest- this is about committing a genocide, obliterating the Palestinian healthcare system, killing and detaining Palestinian doctors so that the living wounded also die and then silencing those with the moral authority trust to be believed British healthcare workers.
