I had fun with this one, connecting Taylor Swift's fight for her rights to John Fogerty's Supreme Court win for his, and all of it to the deeply mistaken idea that new IP rights in "style" will be anything but disastrous for artists. Newsletter below; note here: recreatecoalition.org/a-note…
Big week in tech policy and copyright. The latest Re:Create Recap newsletter delivers the TLDR: 🟠 The CREATOR Act: @bc_butler warns that trying to copyright an artistic "style" will be a disaster for creators, giving corporations the power to block new work through endless lawsuits. 🟠 Unbalanced Legislation: CA AB 412 and H.R. 6028 push an impossible approach to copyright policy that would have major impacts on the creative industry. 🟠 AI Fair Use Hypocrisy: Media giants are weaponizing copyright against AI training, despite relying on fair use daily. 🚨 Today, the House voted to pass the “Legislative Branch Agencies Clarification Act,” a bill that would make the Register of Copyrights a position appointed by @POTUS instead of the Librarian of Congress.

Infrastructure players like Cloudflare need to be neutral hosts. The alternative is censorship and suppression for the disfavored-- which, if you haven't noticed, is increasingly us.
Extremists don't build their own internet infrastructure — they use industry-leading providers. A recent @ADL report finds that @Cloudflare is keeping the lights on for violent extremism, graphic violence and terrorism online — failing to prevent its services from platforming these dangerous websites. Tech companies can no longer claim ignorance. Read the full findings: adl.org/resources/report/kee…

Double bad that EVERY SINGLE PRIVACY BILL Congress has ever proposed would eliminate the unique privacy obligations of phone companies. Your phone info will b treated like your browser history.
Look out: The FCC wants to force phone companies to collect and store your personal information when you buy a phone. Bad idea. Yet another threat to anonymous speech. And @JayCStanley is 100% right:

Weird, because the FCC doesn't actually have anything to do with screen time in schools. it is obligated by law to subsidize internet connections. Schools set their own rules and curricula.

It's not even like this was a surprise. There was a last minute "rural hospital" fund injection in the statute, if I remember correctly. But it was basically barely enough to cover closing costs. Hoping the FCC doesn't eliminate the telemedicine fund.
I think it’s really under-appreciated that a core fact of American politics is Republicans have this extreme outlier view of health care that no other major political party in the world tries to uphold.

Hamas is in full panic mode over the June 26 calls for mass protests against its violent, authoritarian, fascistic rule in Gaza. It has unleashed its agents, operatives, loyalists posing as “journalists,” West Bank activists, online propagandists, and terror networks to incite violence, demand a crackdown, and even organize counter‑demonstrations. Hamas is circulating flyers calling for protests demanding the resignation of Nikolay Mladenov, the Board of Peace executive committee chair overseeing the National Committee for the Administration of Gaza (NCAG), after he criticized Hamas’s stalling and obstruction. Even worse, Hamas supporters in the West Bank, including the vile “journalist” Souad al‑Khawaja, are openly calling for the killing of anyone who protests against the terror group and its “resistance.” Expect the same from Western “pro‑Palestine” circles in Europe and the US: they will smear anti‑Hamas protesters as “collaborators,” “traitors,” “Israeli agents,” or “suspicious individuals.” We saw this during the war, when thousands of Gazans demanded the release of hostages and an end to the conflict Hamas ignited. Watch closely how the most anti‑Palestinian elements of the “pro‑Palestine” cult will once again find any excuse to side with Hamas over the actual people of Gaza.

Gotta agree here.
MIKA: Given your sexting, can you call for the release of the Epstein files and not be conflicted in any way? PLATNER: Yes, of course. I engaged in consensual romantic activities with adults at an earlier part of my life. That seems like a fairly normal thing most people do. Going to an island with billionaires to possibly assault children is a vastly, vastly different thing.

OMG!OMG!OMG! BBC, make this happen!
A (relatively) quick note to respond to the (much appreciated) scores of (very nice) notes online regarding today's news about Doctor Who. My interest and record is well-established; the only real question I think the BBC would (very fairly) ask is: would British fans be open --

Every law student needs to read these transcripts. Do not let this b you
Comedy of AI errors: Lawyers on both sides of a case misuse AI, cite fake hallucinated cases. At the show-cause hearing, "each of the attorneys expressed embarrassment and apologized to the Court." "Neither of them verified the legal authority output by AI before filing their briefs." In other words, there were two clients who basically were paying for ChatGPT (or whatever LLM) to argue against itself. Neither of them realized this until the court issued the OSC! Fines all around (between $1,000 and $3,500), other sanctions include pro hac status revoked, disqualified from practicing in the district for 2 years, among other things:

The California legislature is poised to pass a strong antimonopoly law, which would give the state new tools to spur competition, protect workers and small businesses, and bring down prices. But only if lawmakers standup to powerful lobbyists. @TeriOlle with a good op-ed
OPINION: To help address rising costs, California should update its 119-year-old antitrust law and curb monopoly abuse by dominant firms, including Big Tech. sfchronicle.com/opinion/open…

As I noted when I first blogged on this, the statute prevents treating any thing classed by the FCC as an information service as a common carrier.
.@Google search not a common carrier, Ohio appellate court confirms. prior: mediapost.com/publications/a…
