100% there is no genocide in Gaza. No eradication project. People confused about what the word means is culturally appalling and dangerous for the future of western society. The confusion has indeed been engineered by people know what they are doing. No genocide does not mean simply too much death and destruction in war. It is about intent and action to destroy a national, ethnic, racial, or religious group, in whole or in part. Sam Harris @MakingSenseHQ is spot on.

Alright, but it *isn't* genocide because the elements of the crime are clearly missing. This is a blood libel that has caused Jews to be murdered. It must stop. Not a single accusation has been able to establish that intent is present to the standard required. Not a single one has used the appropriate legal analysis to make the legal conclusion that they do. Each accusation has systematically ignored the conduct of Hamas in relation to informing us about Israeli conduct and what is permissible. This violates the key provisions of the jurisprudence because it ignores the test that must be taken, known as the only reasonable inference test. Here, from Bosnia v. Serbia (2007), para. 373: “The dolus specialis, the specific intent to destroy the group in whole or in part, has to be convincingly shown by reference to particular circumstances, unless a general plan to that end can be convincingly demonstrated to exist; and for a pattern of conduct to be accepted as evidence of its existence, it would have to be that it could only point to the existence of such intent.” When each accusation ignores the conduct of Hamas, it fails to assess the reasonable alternative explanations. If there exists reasonable alternative explanations, such as human shielding (see: GCIV 28 & API 51(7)), weaponization of healthcare infrastructure (see: GCIV 19), diversion of aid (see: GCIV 23), it cannot possibly be genocide. We do know, with plenty of evidence, that each of these is relevant to the analysis because we know that Hamas has utilized human shielding (they admit to it and have done this for decades), have weaponized hospitals (Mohammad Sinwar was killed under the European hospital and we hear from Gazans about the presence of armed militants), and have diverted aid (Al Jazeera confirmed this just yesterday), then it cannot possibly be found that dolus specialis is present. If dolus specialis is not present, it cannot be genocide. Moreover, substantiality is very clearly missing. From, Krstić: "It is well established that where a conviction for genocide relies on the intent to destroy a protected group “in part,” the part must be a substantial part of that group. The aim of the Genocide Convention is to prevent the intentional destruction of entire human groups, and the part targeted must be significant enough to have an impact on the group as a whole. Although the Appeals Chamber has not yet addressed this issue, two Trial Chambers of this Tribunal have examined it. In Jelisić, the first case to confront the question, the Trial Chamber noted that, “[g]iven the goal of the [Genocide] Convention to deal with mass crimes, it is widely acknowledged that the intention to destroy must target at least a substantial part of the group.” The same conclusion was reached by the Sikirica Trial Chamber: “This part of the definition calls for evidence of an intention to destroy a substantial number relative to the total population of the group.” As these Trial Chambers explained, the substantiality requirement both captures genocide’s defining character as a crime of massive proportions and reflects the Convention’s concern with the impact the destruction of the targeted part will have on the overall survival of the group." In Sikirica the chamber stipulated that about 3% is not substantial enough to constitute genocide. In Gaza the death toll, including combatants and not accounting for live births (which outnumber measured death) is about 3.25%. If we want to discuss live births, we would see population increase over the course of the war. Per Save the Children, the UN, and Palestinian Ministry of Health officials the births throughout the war ranged from about 4,000 - 5,500 per month. 4,000(30)=120,000 5,500(30)=165,000 120,000-72,500= 47,500 165,000-72,500= 92,500 So, we can demonstrate that the population has not decreased as measured in death vs. birth, but the opposite. It is very clearly not genocide if you actually understand what genocide is and how it works. This is very clearly a blood libel that has caused the very harm you are saying you are speaking against, @shannonrwatts. I think your heart is in the right place, Shannon. But I also think that you are helping cause the very problem you are speaking against here by helping perpetuate the blood libel that is very clearly erroneous and has caused real and demonstrable harm against Jews. You cannot be an ally and spread the blood libel. And you must stop pushing it.

I’m the Mum of Barnaby Webber, one of 3 innocent victims of the Nottingham attacks in 2023. Where Valdo Calocane was allowed to roam the streets with a lengthy history of violence, assaults, hatred and mental illness because the health services feared the stigma of detaining him for his race and age above safety to the public. Thomas Sowell is 95 years old. Let that number sit with you. Ninety-five years on this earth, and in all of them, he has never held public office, never had a viral moment, never begged for anyone’s attention. What he has done is write 30 books and spend 50 years of patient research building a body of work that has outlasted every fashionable idea his critics tried to bury him with. While the loudest voices in Washington were chasing polls and the cleverest minds on campus were chasing grants, Sowell was in the library reading the data, tracking the outcomes, and dismantling one bad idea after another. He doesn’t argue feelings. He measures results. He isn’t selling anything. His whole approach boils down to one line that every politician and activist in this country should be forced to recite before they open their mouths: “There are no solutions. There are only trade-offs.” Sit with that, too. Every federal program, every mandate, every well-meaning crusade carries a cost, and somebody pays it. Sowell’s life work has been the simple act of asking who. Listen to him on the “help” our communities have been promised for two generations: “I’ve been doing studies now for 20 years of programs designed to increase equality. They increase inequality.” “Even when the programs are designed for disadvantaged groups, they help the affluent members of the disadvantaged groups, while the lower members of those groups fall further behind than ever before.” That is the whole affirmative action racket laid out in two sentences. The kids from the same zip codes as the Harvard faculty get the slot, while the kids from the neighborhoods that actually need a ladder are told to wait their turn. Sowell says it plain: “The vast majority of blacks who go to places like Harvard, Cornell, and Stanford are not blacks from the ghetto. They’re from the same neighborhoods as the whites there.” The race hustlers don’t want you to know that, because they need the grievance to stay in business. Sowell’s advice to young people cuts right through the hustle: “Stay away from the race hustlers.” “Equip yourself with skills that people are willing to pay for.” That is the whole ball game right there, a matter of skills, work, and accountability rather than slogans, hashtags, or another federal program designed to pad a consultant’s salary while leaving the South Side worse off than before. Here is the line I want every young person in Cincinnati, Cleveland, Columbus, and every other corner of America to read tonight: “Much of the social history of the Western world over the past three decades has involved replacing what worked with what sounded good.” That one sentence explains our schools, our cities, and why the neighborhoods the War on Poverty was supposed to save are in worse shape now than they were before the checks started flowing. Sowell has pushed a whole generation of us to stop reacting and start asking harder questions. What are the incentives? Who actually benefits from this policy? What do the numbers look like five, ten, twenty years later? Ask those questions honestly, and the illusion falls apart. The most dangerous man in America right now isn’t the one shouting on television. He is the 95-year-old professor in Palo Alto who doesn’t need you to agree with him, because he has the data on his side. Ninety-five years of telling the truth. Thank you, Dr. Sowell.

It’s strange how events in other countries serve to highlight the direness of our own situation. The internet has been shut down in Iran; the despised regime is killing its citizens; great swathes of the country are in open and glorious revolt, despite the inevitability of torturous reprisals. The raw bravery on display is nothing short of staggering. Imagine if that were Israel. Just imagine. The marches in our towns and cities, the banners, the attacks on synagogues, the swastika graffiti, the calls for global intifada, the 24-hour coverage on the BBC. The whole sorry mess. But it’s Iran. And our performative empaths—the colonisers of the institutions—are rocking back and forth in a kind of constipated silence. Because somewhere along the line, they cultivated a fetish for Islamist psychopaths, believing them to be symbols of beautiful resistance. That’s bad enough. But there’s the bigger problem: the general chattering classes who’ve turned a blind eye to the evil of Pakistani rape gangs and virulent antisemitism because they think it’s racist to complain. Seriously. Thank you to the people of Iran—and to Israel—for your bravery, and for helping expose the cancer at the heart of our rotten society.
