Eu alertei na minha coluna que a Lei Felca pode sim bloquear o Linux no Brasil. E aqui está a prova de que a ANPD, o órgão regulador, concorda comigo. Eles abriram consulta pública que se encerra nessa segunda-feira (15/06) sobre o Guia Orientativo, o documento em que informam à sociedade o entendimento atual da agência sobre a aplicação da Lei Felca. Na versão sob consulta popular do guia, diz a ANPD textualmente que sistemas operacionais que sejam software livre nãp podem ser demandados a cumprir as obrigações da Lei Felca. Na imagem destaco o trecho mais importante. É necessário que isso seja dito neste guia pela agência porque a Lei Felca em si em seus artigos 35 e 40 *NÃO* dão qualquer ressalva, liberação ou garantia de isenção a sistemas operacionais e gerenciadores de pacotes que sejam software livre. Como apontei no meu artigo, a única proteção ao Linux e similares na lei é um ato de boa vontade discricionário da ANPD já que a Lei Felca em si não dá exceção objetiva e indiscutível a ele. Nossa legislação deveria estimular o software livre como política pública e não deixar o uso dele como uma permissão de boa vontade de um órgão. Portanto, é necessário que a comunidade Linux revise o Guia Orientativo da ANPD sob consulta até o próximo dia 15 e verifique se ele contempla temporariamente as necessidades da comunidade do software livre. Ainda assim, é importante não esquecer que tal guia é um documento em que a agência registra sua atual interpretação da lei e que pode mudar com o tempo. Se o texto da ANPD diz que não exigirá do Linux as obrigações da lei citando ele por não ter "acesso provável por menores" e não ter "significativo grau de risco à privacidade, à segurança ou ao desenvolvimento biopsicossocial de crianças e de adolescentes", ambos entendimentos podem mudar radical e rapidamente. Basta o surgimento de um único caso de menor de idade usando Linux para burlar a lei e que se torne vítima e uma comoção popular sobre o caso para que tais colheres de chá sejam retiradas pela ANPD. Afinal, a própria Lei Felca com sua aprovação emergencial e sanção antecipada são reações do poder público ao fenômeno midiático do vídeo do Felca. A proteção ao Linux vir num guia orientativo em vez do texto da lei é dizer à comunidade que a ANPD é um cachorro manso que não morde. Essa frase é sempre antes de uma mordida surpresa acontecer. É importante que esse entendimento atual da ANPD no Guia Orientativo seja cristalizado como emenda na Lei Felca para que qualquer futura mudança dele dependa do processo legislativo, não um ato de boa vontade da ANPD que é uma agência reguladora tão quanto a Anatel é uma. By the way, public service announcement: if you're one of the numerous people posting about Anthropic's dystopian ways and you're thinking about getting Claude to help you write that post... don't! Another one of their terms is that you may not use Claude to do anything that "exposes [Anthropic to] reputational harms" 👇 And, if you do, under the - extremely unusual - clause 13 of their terms (anthropic.com/legal/consumer…), you have PRE-AGREED, by using Anthropic (and accepted their terms), that the harm you've done is irreparable, that you won't oppose Anthropic injunction, and they don't need to prove actual damage. They can simply go to a judge in a friendly jurisdiction (and of course, their terms precise that any dispute "will be resolved exclusively in the state or federal courts located in San Francisco, California") and: a) file an injunction that shuts you down b) make you pay for everything since under section 11 of their terms you agree to indemnify Anthropic for "any and all liabilities, claims, damages, expenses (including reasonable attorneys' fees and costs), and other losses arising out of or related to your breach or alleged breach of these Terms." In other words, if you use Claude to help you talk shit about Anthropic publicly, their terms say you pay their lawyers to go after you and you've already pre-agreed you've lost the case. Oh, and cherry on the cake: in the odd case the judge were like "are you crazy, this is insanely abusive, you Anthropic are the ones at fault here," according to their terms Anthropic's maximum liability is... $100.
