Το Cloud Act Αντιστρέφεται: Η ΕΕ Κλείνει την Πόρτα στους Αμερικανούς Hyperscalers Η Ευρωπαϊκή Επιτροπή ετοιμάζεται να παρουσιάσει τον Cloud and AI Development Act, μία νομοθεσία που εισάγει υποχρεωτικά κριτήρια «μη κόστους» στις δημόσιες συμβάσεις για ευαίσθητους τομείς, όπως η ενέργεια, τα χρηματοοικονομικά και η υγεία. Στην πράξη, αυτό σημαίνει ότι υποδομές λογισμικού και υλικού πρέπει να αναπτύσσονται εντός ΕΕ, κάτι που αποκλείει de facto τους μεγάλους αμερικανικούς παρόχους cloud, Amazon, Microsoft και Google, από κρίσιμες κρατικές συμβάσεις. Η κίνηση δεν είναι τυχαία: ο αμερικανικός Cloud Act παρέχει στις αμερικανικές αρχές πρόσβαση σε δεδομένα ανεξαρτήτως γεωγραφικής αποθήκευσης, και η ΕΕ κρίνει αυτό ως δομικό κίνδυνο για την κρατική κυριαρχία. Η πρόταση δεν είναι μόνο ρυθμιστική, είναι και βιομηχανική πολιτική. Η Επιτροπή σχεδιάζει να λειτουργήσει ως κεντρικός αγοραστής υπηρεσιών cloud και ΑΙ για τις χώρες-μέλη, ενώ παράλληλα δρομολογεί επιταχυνόμενες διαδικασίες έγκρισης για κέντρα δεδομένων που χρησιμοποιούν ευρωπαϊκά chips. Είναι προφανές ότι η ΕΕ επιδιώκει να δημιουργήσει οικοσύστημα cloud sovereignty που να μην εξαρτάται από αποφάσεις της Ουάσιγκτον. Δεν πρέπει να ξεχνάμε ότι λίγες εβδομάδες πριν, η Επιτροπή ανέθεσε σύμβαση sovereign cloud ύψους 180 εκατομμυρίων ευρώ αποκλειστικά σε ευρωπαϊκούς παρόχους, εξαιρώντας ρητά τους αμερικανικούς hyperscalers. Για χώρες όπως η Ελλάδα, αυτή η εξέλιξη έχει άμεσο αντίκτυπο στον τρόπο που σχεδιάζεται η ψηφιακή υποδομή του δημοσίου τομέα. Το ερώτημα δεν είναι αν η cloud sovereignty είναι επιθυμητή, αλλά αν υπάρχουν ώριμοι ευρωπαϊκοί πάροχοι ικανοί να καλύψουν τη ζήτηση σε κλίμακα, χωρίς να δημιουργηθεί νέο τεχνολογικό έλλειμμα. AWS και Azure Ως Gatekeepers Υπό το DMA: Η Ευρώπη Ορίζει τα Νέα Όρια της Ψηφιακής Αγοράς Cloud Η Ευρωπαϊκή Επιτροπή ετοιμάζεται να χαρακτηρίσει τα τμήματα cloud της Amazon και της Microsoft, δηλαδή το AWS και το Azure, ως «gatekeepers» υπό τον Κανονισμό για τις Ψηφιακές Αγορές (DMA). Η διαδικασία δεν είναι αιφνίδια: ξεκίνησε τον Νοέμβριο του 2025, όταν η Επιτροπή άνοιξε τρεις έρευνες αγοράς με το επιχείρημα ότι και οι δύο πάροχοι κατέχουν πολύ ισχυρή θέση στην ευρωπαϊκή αγορά cloud και είναι ουσιαστικά αναντικατάστατοι για μεγάλα τμήματα της ψηφιακής οικονομίας. Το Google Cloud εξαιρείται προσωρινά, λόγω της συγκριτικά ασθενέστερης παρουσίας του στο συγκεκριμένο τμήμα. Αν ο χαρακτηρισμός επιβεβαιωθεί, AWS και Azure θα έχουν έξι μήνες για συμμόρφωση. Στην πράξη, αυτό μεταφράζεται σε ανοιχτότερες συνθήκες πρόσβασης, περιορισμούς στη δέσμευση ιδιόκτητων υπηρεσιών, μεγαλύτερη διαφάνεια στην επεξεργασία δεδομένων και αυστηρότερες υποχρεώσεις διαλειτουργικότητας. Σε περίπτωση παραβίασης, τα πρόστιμα φτάνουν έως το 10% του παγκόσμιου κύκλου εργασιών. Δεν πρέπει να ξεχνάμε ότι το επιχείρημα των επικριτών, ότι δηλαδή το DMA είναι δομικά ακατάλληλο για την αγορά cloud γιατί δεν υπάρχει «κλασικός» gatekeeper-intermediary, δεν είναι απλώς εταιρικό λόμπι. Η αρχιτεκτονική του cloud διαφέρει ουσιαστικά από αυτή ενός marketplace ή ενός λειτουργικού συστήματος. Η παροχή υποδομής δεν ταυτίζεται αναγκαστικά με τον έλεγχο πρόσβασης σε αγορά τελικών χρηστών, κι αυτή η διάκριση θα κρίνει πόσο αποτελεσματικές θα αποδειχθούν οι υποχρεώσεις στην πράξη. Για την Ελλάδα, η εξέλιξη έχει διπλό αντίκτυπο. Το ελληνικό δημόσιο και μεγάλο μέρος της αγοράς βασίζεται ήδη σε υποδομές AWS και Azure, οπότε κάθε αλλαγή στις συνθήκες αδειοδότησης ή τιμολόγησης επηρεάζει άμεσα το κόστος και τη στρατηγική προμηθειών. Από την άλλη, οι απαιτήσεις διαλειτουργικότητας ανοίγουν ένα παράθυρο ευκαιρίας για ευρωπαϊκούς παρόχους που επιθυμούν να ανταγωνιστούν σε ένα πεδίο που ιστορικά κυριαρχείται από δύο ή τρεις αμερικανικούς κολοσσούς, αρκεί να υπάρχει η τεχνική ωριμότητα για να αξιοποιηθεί η ευκαιρία.
